Some days, it's really not worth getting out of bed.
Today, I discovered a really big mistake I made at work. BIG mistake. No excuse for it, except a major brain fart on my part.

Then, I picked up the mail, and there was a letter from the landlord, raising our rent effective immediately, $60. No warning, no nothing, just, fork it over.

And that's only today.

The past 4-5 days have mostly been shit, shit, and more shit.

Somebody put me in a coma, please. I'd like to disengage for a few months.

x(

12. Wish I could fix everthing for you ,SG
However, i think I can fix one thing...
You get to tell him, "Sorry, Dude...in writing, 30 days notice on that increase."

http://www.wsba.org/media/publications/pamphlets/landlord-tenant.htm

Rent Increase

If there is a lease for a specified period of time, the rules of the tenancy, including the rent, may not be changed during that period. In the case of a periodic tenancy (such as month-to-month rental agreement), the rules, including the rent, may be changed upon 30 days' written notice. Rent increases cannot be in retaliation for the tenant's assertion of his or her lawful rights. The landlord may charge a late payment fee if the rental agreement expressly provides for the charging of a late fee.

18. Oh yeah, that's the other thing.
They added a shitload of late fees too.

Fer cryin' out loud, we've lived here for 15-16 years. Lately, it's been a bit of a struggle financially, but we're getting back on track.

30. Did he already give you 30 days written notice?
Edited on Thu Jan-10-08 09:01 PM by Whoa_Nelly
Are you month-to-month, or a lease (question out of curiousity...no need to answer if you don't want.)

If you were not given 30 days written notice on a month-to-month agreement, he cannot demand increase OR charge late fees.

And if it's a lease, terms cannot be changed until renewal, and even then he needs to give you notice for your option to renew.

31. We're month-by-month.
Frankly, I think this is in retaliation for being late a few times, even though we kept them informed of what was going on, and are back on track.

36. he can charge late fees
But, he cannot, by landlord tenant law, up the rent without 30 days written notice.
He doesn't get to arbitrarily punish you.

And he knows that, am sure.

Glad things are getting back on track

Hang in there

Yeah, it does get better. I don't usually have a string of 4-5 days in a row where mostly bad things happen. Hopefully, I'll have a long string of GOOD days soon.

17. I'm not sure that's legal.
http://www.tenantsunion.org/rights/23/rent-increases

If I'm reading this right, your rent increase (assuming your rent is due on the 1st) can't legally be effective until March, if you received it today.

22. I figured I was.
I used to manage property. California's fairly tenant-friendly, so the rules I'm used to don't apply everywhere, but changing an existing contract with <30 days written notice isn't something many civilized places permit.
