Update on the guy who nearly hit me.
Well, the guy who nearly smeared me, as noted in this thread:

He's sobered up and is out of jail, his wife posted the bail.

He still is going to be charged with all the offenses listed.

But I stand practically NO chance of getting a dime out of him.

All his assets, including that SUV he was driving are in his relatives' names.

I was put in touch with an attorney who had sued him before, and he had a judgment against him.
(Drunken car accident)

But the plaintiff has yet to get a dime.
And it's been almost 2 years.

So I'm just happy he's facing 5 years in jail.

1. where do you live?
in dc, critical mass puts up old bikes that are painted white and put them where bikers have been almost/hit to alert drivers about bike riders.

and i was riding with my roommate and saw him get doored. justin was okay but the car owner didnt even put out his cigarette while justin got off the ground. (driver was in an suv by the way).

3. If There's Insurance Involved
Which there should be, go after that in his relatives' names to collect your medical expenses. Only two states plus DC waive the Insurance requirement.

Otherwise and concurrently, nail his ass to the wall as being a persistant offender. With any luck, he'll serve more than 5 years sober and you may have saved a few other lives in the process.

5. Me Too
When some guy left his unleashed puppy dart from between parked cars and into my front bike tire last Autumn. On impact the tire twisted left and I flew 8 feet to asphalt and tore a hole in my right elbow. I needed stitches but didn't get them. I was in near shock, bleeding yet I had empathy for the puppy which didn't appear badly hurt. I walked a mile home before I started thinking rationally about what occurred. THE GUY WAS AT FAULT IN NOT LEASHING HIS PUP!

On his part.

You could, if you wanted, still sue him. Even though you know you won't get anything, and you'll end up paying the lawyer yourself, you could suimply drive him into bankruptcy with legal fees.

But otherwise, sounds like your on your own.

Drunk drivers are a real stain and menace, and I don't think our drunk driving laws are anywhere near stiff enough. And as we know, WI is full of 'em.

Glad to hear you are feeling better.

after the relatives. sounds like fraudulant practice and evading judgements. as they say-follow the money-you may end up owning the suv.

who pretty much said you would win anything. Now you can go on with your life. Hope you can adopt maintain a positive outlook about people now.

Cmon this is America, so many 'frivilous lawsuits', surely you can sue him (your case is actually valid).

IF not, at least go to his trial, give damning testimony!
