MONTVILLE -- A township mother is suing the school district for failing to protect her son, a high school student with disabilities, who was allegedly mocked and assaulted in a video appearing on YouTube. The video was first produced by classmates for a school assignment.

The acting school principal at the time said on Tuesday night that the original video showed a teacher breaking up the bullying and included an anti-bullying message. Only the bullying portion was on YouTube, she said.

The Montville High School student was shown in the YouTube clip having garbage cans emptied over his head and being slapped and pushed to the ground, according to a lawsuit filed in state Superior Court in Morristown Tuesday.

The student is described in the lawsuit as having multiple cognitive and social disabilities.

Her headline implies that YouTube is somehow involved, and it isn't.

Her writing is also confusing.

6. The issue is with the people who made the video, and the school staff who allowed it

Under SpEd Law, confidentiality is the biggest imperative. That means that no student under the umbrella of any SpEd services can be openly identified, either visually, (on tape, not meaning cannot be seen while at school), verbally or by name in the public school setting beyond those who have the right to know, e.g., the IEP team, which includes any and all teachers on the IEP, parents, and any other service personnel. If the student is to be taped, permission must be given by the parent before that can happen.

The parent is exercizing her rights to due process per IDEA (Indiviuals with Disabilities Education Act).

The prinicpal, who IS a member of all the IEP teams for all the SpEd students at the school should have not allowed this to begin without taking the first step, which is to get written authorization from the parent to film this, along with giving the parent all the information as to why, how, when and where this tape would be made and where and by whom it will be viewed.

There is no excuse for any of this.

I say, Go to it, Mom! They blew it!
