31 Year Old Teacher Arrested For Having Sex With Her 13 Year Old Student

A teacher at the private Newark Boys Chorus School was charged Tuesday with sexually assaulting one of her students, a 13-year-old, during encounters at her Morris County home and in a hotel.

Tracy Booth, 31, was held on $200,000 bail following her arrest late Monday at her home in Mount Tabor, Essex County Prosecutor Paula T. Dow said.

A message seeking comment from Booth's lawyer, Marcy M. McMann, was not immediately returned.

The school headmaster, Lawrence C. Emery, said that Booth has been suspended and that the school is cooperating with police.

"All students, parents and faculty have been notified of these allegations and professional counselors have been made available," Emery said in a statement.

Prosecutors said the first sexual encounter took place at Booth's home in the fall, with a second at a Newark hotel, and a third at her home in February.

Booth had been the boy's English teacher for several years, Dow said.

The case developed following an anonymous call March 1 to the state Division of Youth and Family Services. Newark police then got a statement from the boy and contacted the prosecutor's office, she said.

Booth was charged with two counts of aggravated sexual assault and one count of child endangerment relating to the hotel encounter. She could face similar charges regarding the two encounters at her home, Dow spokesman Paul Loriquet said.

The sex assault charge carries up to 20 years in prison.

The school's Web site said it was founded in 1969 and serves fourth- through eight-grade boys.
