Police violated drug suspect's rights, state appeals court says

Milwaukee police conducted an unreasonable search of a suspect when they forced him to ingest laxative in order to pass a plastic bag of heroin he swallowed during a drug bust, the state Court of Appeals ruled Tuesday.

After being arrested for possession of a controlled substance, Payano-Roman was taken to Froedtert Memorial Lutheran Hospital in Wauwatosa, where he was handcuffed to a bed.

After the situation had been explained to medical personnel, a nurse told the officers that administering a liquid laxative would "speed up the process by which things would be passed through (Payano-Roman's) system."

The suspect was then directed to drink the laxative every 20 to 30 minutes and was administered about six cups by either a nurse or a police officer.
