Grandparent Visitation Rights Struck Down in WA State
Edited on Thu Apr-14-05 02:48 PM by mondo joe
For a second time, Washington State's grandparent visitation law has been struck down as unconstitutional.

The state supreme coutr asserts that parents have a fundamental right to raise their children as they see fit, contrary to the existing state law (which replaced an earlier law also struck down in court).

The state law says visits with a grandparent are presumed to be in the child's best interest, even if the parent disagrees. The court found this "directly contravenes the constitutionally required presumption that the fit parent acts in the child's best interests."

I for one am thrilled - especially in light of the Schiavo case. I am deeply opposed to people interfering in the choices of others based on nothing but biology.

4. Good, because neither my parents nor my husband's parents
have the right to dictate to us WHEN they can see their granddaughter.

For the record, my father was glad they struck this down. He simply put it, "They are NOT your children- they're your children's children."

A-freakin-men.
