Help! My idiot brother...
He agreed over the phone to buy 6 magazine subscriptions for the next five years at a ridiculous price. He did this while so drunk that he didn't even remember till a letter showed up in the mail. He called and said he didn't want it and they said it didn't matter 'cause they had a voice contract recorded. They say they already paid all the magazine companies and that he couldn't cancel.
Any advice?

They must have a consumer affairs section which loves to go after sleazy companies like this.

5. How do they know it was really his voice?
If it were me, as soon as the invoice came in I'd write cancel across the front of it and return it to them.

I'm not sure but he might check when he gets correspondence from them because there may be a 'buyers remorse' clause that covers this type of transaction.

If he was really that drunk, it may be obvious on the tape. I don't think even the sleaziest company would want to go to court with THAT as their evidence.

9. most systems today
inform a CALLING party that they will be recorded...but I don't know about CALLED parties. Also, would it matter if this was a single-side notification state? In that case, the agent making the call would be informed...

10. Don't pay. Period.
They'll stop sending them when they realize they're not getting any money. If he was dumb enough to give a credit card number, tell him to both call the c.c. company and send them a written statement putting the charge in dispute. Make the telemarketers prove they have a "voice contract" (never heard of this, is it legal, DU lawyers?), and check if it is legal to record w/o permission in your state. In complaints, have him say that he has called to cancel before receiving any magazines, and he does not want them, end of story. Again, DO NOT PAY.

11. We found a state law giving him 30 days
So he called and told them we contacted the SAG and found the law and they cancelled it. We will still be sending letters to the SAG and the BBB. Thanks for your help guys.
