1. The problem is
...under California Law it is legal to buy someone's vote as long as the election is NOT at the Federal level.

I don't know where to find this, but I was watching CNN and I heard this about 3 weeks ago.

Buying and selling votes is illegal everywhere in the US. Here's an article from '00 about a parody vote auction site. CA Secretary of State is quoted to the effect that he will prosecute anybody trying to sell votes; no exceptions for non-federal elections mentioned:
