I don't know how the asshole managed to miss the duck, but it took wing and got across the road unharmed.

they KNOW the rules and usually (at least in DC) choose to break them.

when it gets mauled by the grill & wheels of a '78 rustbucket and lays dying in the street, it doesn't know why. It doesn't know that it's dying and in pain because human beings encroached on its world with absolutely no regard for it or anything else they appropriated.

It only knows the pain and the misery of dying and the terror of more oncoming wheels.

That kind of dumb.
