Orcas - 1, Bush Administration - 0.....
In a major set back to the Bush administration, a federal judge ruled that the Bush Administration's use of faulty science was wrong and that the Puget Sound's Orcas should get protection under the Endangered Species Act....

U.S. District Judge Robert Lasnik gave the National Marine Fisheries Service a year to rework its July 2002 decision and propose a new course of action — a move environmentalists claimed would likely bring more help and attention to the plight of the charismatic creatures.

"This is huge," said Kathy Fletcher, executive director with People for Puget Sound. "I can't tell you how happy we are."

While the judge stopped short of ordering the agency to list the whales, "it appears the writing is on the wall," according to Brent Plater, an attorney with the Center for Biological Diversity, which initially petitioned the agency to protect the orcas under the species act. "I just don't see a lot of wiggle room."

1. Yes, this is very good news
for the Orcas and us - seems like the Bushies are getting creamed in a lot of decisions coming down in the past few days - this is why it is sooooooooooooooooo important that appointees to the Federal Bench are not the right wing whacko nut cases that they are trying to push through - thank God for the good judges we have left.

4. Again, it is clear that the branch of government
most resilient to neofascist Bushevik takeover is in fact the judiciary.

Although I continue to wonder just how long they can hold out in the face of Bushevik Loyalists being jammed in there, which will ultimately create sea-changes in judicial mores as surely as Bushevik infiltration/parasitization of the Corporate Media and the creation of the Party-Loyal Right-Wing Sub-Media turned the Formerly Free Press from being envied by the world to a Gloabal Laughingstock.

And the shadow of Totalitarianism creeps ever closer.
