Cornyn plan keeps Congress full in case of emergency
But opponents say lawmakers should be elected not appointed. It's an oversight that Texas Republican Sen. John Cornyn aims to fix with a proposed amendment he unveiled Wednesday that would let Congress or the states set the rules for filling widespread vacancies.

It's not a favorite topic on Capitol Hill. But what if the Sept. 11 hijackers had managed to guide a plane into the Capitol, or if the anthrax attacks had sent dozens of senators to intensive care? What if terrorists strike again, and this time manage to kill scores of lawmakers?

The government would be unable to spend emergency funds or tend to other actions needed in time of crisis – because the Constitution, which sets the rules for replacing a president, says nothing about repopulating Congress in case of catastrophe.

3. makes a certain amount of sense..
if all of Congress were killed somehow, Governors could appoint Senators, but Reps have to be elected...delay would be a very bad thing during that type of crisis

9. No, representatives are also replaced.
Party delegates from their districts appoint a replacement. This is better than allowing a governor to do so -- e.g., a GOP guv to appoint an all-GOP delegation from a state.

7. Some might think that was supposed to happen on 9/11
but perhaps through double cross did not. If it had happened, * could already be the "official" dictator he seems to think he is.
