Warrentless surveillance plus no Habeus Corpus
The courts generally won't be accepting evidence obtained using "extra-legal" methods. They may even closely examine those warrants actually issued to see if the information used to justify the warrant was gathered illegally.

Since Bush has claimed executive authority to declare and detain "enemy combatants" without due process this probably won't be much of a hinderance to this Administration's efforts.

I wonder how many people are locked up who were imprisoned without any interaction with the courts whatsoever. No warrant for surveillance, no warrant for arrest, and no trial.

We'd be hearing about it if people were missing and no one knew where they went, right?

as none of the targets of Bush's domestic spying have ever or will ever go to trial.

- Bush spies on his political enemies... like the Kerry campaign .. to cheat on the election and day-to-day govt.
- Bush spies on his base ... like the Freeps, Fundies, even the RNC and Congress ,,, to keep a firm grip on power.
- Bush spies on publicly traded business .. to favor his friends and extract illegal profit.
- Finally Bush spies on what they call "terrorist operatives"... who... in the govt's sole view... are "undesirables".
These unfortunate individuals are rendered away to some secret Easern European or Central Asian gulag
without any proof, due process or any justice whatsoever. They are just "disappeared".

Bush has no intention of involving the courts.... look at all he's doing to AVOID the courts.
Hopefully the courts will strike back.

Considering the Alito's writings that were just released he'd do the exact opposite. I guess Bush considers him the right man for the right job at the right time.
