If Bush does not have the right to break the law, then -- aside from arguing that the Congressional authorization to use force in Afghanistan allowed warrantless eavesdropping on American citizens at home -- there is no defense to Bush's having ordered warrantless surveillance when FISA expressly prohibited that. Thus, many Bush defenders are now arguing, as they must, that a "wartime" President's power is so vast that it even includes this law-breaking power.

On its face, this theory that Bush as a "wartime" President has the right to break the law squarely contradicts their insistence that they are not advocating for monarchic rule. Once you advocate a theory that authorizes a President, even during times of an undeclared and endless war, to violate any Congressional laws he wants as long as he says -- with no judicial review possible -- that doing so is for the sake of our security, what possible checks or limitations on Presidential power are left?

1. I think we should keep focus on Iraq
Under current president and current make up of the judicuary. I believe that the SCOUTS will uphold the right of the president to do what he did.

And a growing insurgency which threatens the stability of this volatile region and threatens the security of the rest of the world?! Terrorists are now being made here, unlike under Saddam, who wouldn't have put up with this, for a moment. Yes, we sure should be focused on Iraq. The mess that Bush* has created here will threaten the rest of the world for generations to come.

And I agree that this was his right. But whether this was right, or not, is a whole other question. IMO, this was the biggest blunder of the 21st century and believe that history will vilify him, in a huge way.

11. Wrong!
Precedent is everything to the SCOTUS, no matter who is on it. The precedent, during WWII, The "Red Scare", Nixon, et al are all very clear on this matter. The precedent, even in REAL wartime does not allow the president to do this judicial sidestep.

2. What's left? Who would know but Bush?
First, we have to check with him as to whether he deems any particular liberty consistent with national security.

Second, if he say it is, we have to ask him if he really means it this time or is just saying it to placate us until we discover a secret program.

Third, we have to cross examine him as to meanings of words, unspoken exceptions, and whether they are enforcing the law or just paying lip service.

Fourth, take all our questions and shove them up our own asses because this president doesn't take questions from anybody.
