DoD "has refused to cooperate" with Senate Intelligence Probe
Roberts is beating his chest and vowing to rush through an investigation by the 14th, saying he'll "subpoena the Bush administration for documents as a last resort and interview senior officials if necessary.

But look at the most substantial of the implied obstacles:

A GOP committee aide said it is unlikely the second phase will be finished by Nov. 14 because of likely Democratic objections. The staffer added that another potential obstacle is the Department of Defense, which the aide said has refused to cooperate with the committee because of statements made by Rockefeller.

Rockefeller publicly questioned whether the Pentagon’s office of special plans overstepped legal bounds. The office played a key intelligence role in the lead-up to the invasion of Iraq. News reports have revealed that the office served as an alternative source of intelligence analysis about Saddam Hussein’s weapons capabilities for White House decisionmakers.

See? They don't want to cooperate because Jay already knows he has them dead to rights has raised questions about them?

Those are some *powerful* investigatory tools:

-as a last resort
-if necessary
-if you aren't too offended by the questions

What does the constitution say? Bad DoD get me the news paper. May be the congress needs to hold up DOD's funding for a while?

2. Ideally, but not with Roberts chairing the committee
He hasn't the will to compel them. Maybe all the new attention will make some difference, but he is still holding the cards.

4. Do I hear this right?
The Department of Defense has "refused" to cooperate with a Senate Intelligence Committee (duly appointed and directly elected by the American people) seeking to investigate the use made of intelligence by the Department to justify the U.S. attack on Iraq?

On what basis may they "refuse".

The DOD is part of the Executive Branch. So is Bush. Bush should required the DOD to cooperate, shouldn't he?

3. Seems amazing that Senate oversight can be refused because
a line of inquiry offended someone. Wow, 9-11 really did change everything. Contempt?

The repub Senators bow before the executive.

This leak is from an unnamed aide, but The Hill usually get things right.
