Second judge out for DeLay trial

AUSTIN, Texas - Two days after U.S. Rep. Tom DeLay won a fight to get a new judge in his case, prosecutors on Thursday succeeded in ousting the Republican jurist responsible for selecting the new judge.

Administrative Judge B.B. Schraub recused himself after District Attorney Ronnie Earle filed a motion asking for his removal from the case.

Schraub said he will ask the chief justice of the Texas Supreme Court name a judge to preside over DeLay's conspiracy and money laundering trial.

State district Judge Bob Perkins, a Democrat, was removed from DeLay's case Tuesday after DeLay's legal team cast doubt on Perkins' ability to judge the case fairly because of more than $5,000 in contributions he's made to Democrats.

14. This is vital - Schraub said he would've picked a judge OUTSIDE TRAVIS CTY
Schraub said he was going to choose a judge outside Travis County! WHY?!?! This crime falls within the jurisdiction of Travis County, no other. As such, the trial should be held in the capital.

Earle was simply heading him off at the pass, so to speak.
If he had been allowed to pick a judge outside the correct jurisdiction, he would clearly be jury shopping in some RW stronghold - with NO COMPELLING REASON - other than to handpick partisan jurors.

Good move, Earle - don't let up!

He's trying to find a judge that is friendly towards him and won't hold him to his crimes. Than DeLay can go around and claim that he was so innocent and the democrats in Texas can't defeat him politically so they go after him this way like he was. :eyes:

Cause I thought that Perkins, upon the request of DeGuerin had said he would defer to Schraub who then asked retired Judge C. W. Duncan, who then decided that Perkins not hear the case, so now they are back with the administrative judge that Perkins deferred to in the first place????

Perkins referred the decision to B.B. Schraub, presiding judge of the third administrative judicial region. Schraub on Monday assigned the case to Duncan.

Perkins---> Schraub ---> Duncan--- no to Perkins---> Schraub?

22. Yes. Duncan was only for the Perkins motion.
Schraub then said he would pick a judge from OUTSIDE TRAVIS COUNTY to actually hear the case. Travis County is the correct jurisdiction for this crime. Schraub said he would pick a judge intentionally outside the jurisdiction of the case, allowing DeLay to jury-shop in a RW stronghold most likely.

Earle stopped him by asking for his recusal before he could do that.

Thank God.

So Duncan said NO to Perkins referred decision regarding new judge back to Schraub who was indicating he would go out of jurisdiction, so Earle headed him up to recuse himself to keep it here...


Sure hope it stays here, cause we got ourselves some judges who have no connection or motive to deny lady justice from spanking Mr. Delay...

that the judge in this case is so carefully picked.That way when Delay is found guilty,the reps will find it difficult to point fingers and whine that the fix was in.No matter who the judge is,the evidence is against him.

Ha! Wimpy Dems, do you really believe that Alito SUDDENLY thinks people have a right to a trial on discrimination if they've met the requirements? Or that suddenly Griswold and Roe are peachy keen????

Let's see, I see pro-Alito ads, and don't hear a peep out of any Repub Senators or the Dobson crowd. WHY??? Because Alito is lying and they know it. He's their boy.....

Who did Chief Justice Wallace Jefferson contribute to?



On September 14, 2004, Wallace Jefferson made Texas history as the first African American Chief Justice of the Supreme Court of Texas. He was first appointed to the Court in 2001 to the seat formerly occupied by United States Attorney General Al Gonzales, and was elected in 2002 with 60% of the vote in the contested Republican primary, and 56% of the vote in the contested general election. Governor Rick Perry promoted him to Chief Justice when Chief Justice Phillips retired after 16 years of distinguished service.

Wallace Jefferson is the son of William Jefferson, a retired United States Air Force major, and Joyce Jefferson of San Antonio, Texas. He graduated from John Jay High School in 1981 and received a Bachelor of Arts in Political Philosophy from James Madison College at Michigan State University in 1985. He earned his Juris Doctor degree in 1988 from the University of Texas School of Law.

Chief Justice Jefferson developed an early interest in civil appellate law as a student of the late constitutional scholar, Charles Alan Wright. In 1989, he joined the appellate section of Groce, Locke and Hebdon in San Antonio. He founded his own appellate law firm with Tom Crofts and Sharon Callaway in 1991. Crofts, Callaway and Jefferson soon became one of the preeminent appellate practices in Texas.
