About this "I can't recall" hogwash from Rethugs...this can't stand
Some of you may have encountered my posts on this issue. The ones that say anyone using these bullshit excuses get a free trip to TORTUREVILLE until they get their memory back. I am so sick of their rubbish. Any average citizen in similar circumstances that tried to use the "I can't recall" or "I have no recollection" or "I forgot" or "I can't remember" blah, blah, blah...no average person would be allowed to use such absolute hooey!

Surely this shit can't stand. Isn't it old. Didn't their darling Reagan use it? I think he wore it out or was it Poppy that wore it out?

I don't care. If that trash is accepted there is going to be hell to pay.

4. Average people use it all the time
Lawyers usually advise their clients to use that exact phrase whenever their is any doubt in their mind about something that happened in the past.

It's okay.

It tends to backfire when people start using it excessively, and a good lawyer can draw someone in so that it just sounds ridiculous (juries are not known to cut a lot of slack on it, either).

Another one that really trips my trigger: Hadley at today's press briefing responding to a question about the "secret" Cold War era prisons US is using for detainees.

He starts his response with "well, assuming they even exist."

I HATE THAT!

Previous defenses varied in success

The lack-of-memory defense has worked with varying degrees of success in controversies from Iran-Contra to Whitewater.

Only one person went to prison in the Iran-Contra affair, although several people pleaded guilty to making false statements.

President Clinton and his wife, Hillary, were cleared in the Whitewater investigation of fraudulent land deals in Arkansas, a subject well-suited to a lack-of-memory defense. The land deals took place a decade before they came under criminal investigation.

Tate referred to another possible line of defense, saying that "for five years, through difficult times, Mr. Libby has done his best to serve our country." That argument worked in the administration of President George H.W. Bush in 1992, though not in court.

"I don't recall" should be seen, legally, as "I don't want to remember".

edited: there should be a hard statutory limit on the time one has to "remember". I'd say, two years.

I can remember what I said to someone two years ago, given the proper context of the conversation. Were it to come to a point where I was in court, I'd expect meticulous records of the conversation(s) to be submitted to the court.

I damn well WOULD remember, in such a situation. I expect we all would.

It should NOT NOT NOT EVER be a legitimate cop-out. It should be grounds for contempt of court.

12. Well I was told to read this and I always do as I am told.
NOw what do you wish me to do? If you can recall. Did any one watch the c-span thing on today with McCain? It was sort of funny. This man did not recall one thing when every one said he did it and had e-mails also. This guy must have been in a fog the whole time he was working on this Indian thing. Must have drank his way through his service in the govt.

14. The Reagan Defense.
I remember at the time wondering why in the hell anybody would accept that bullshit. I still can't believe it.

This bastard trick that worked for Reagan in circumventing the law and accountability is certainly an old standby in the Republican book of "What Works".
