Frogmarch alert: Libby in court Thursday, will claim "I forgot"
WASHINGTON - Vice President Dick Cheney's long-time chief of staff, I. Lewis "Scooter" Libby, who resigned last week after being indicted in a CIA leak investigation, is scheduled to make his first court appearance Thursday for an arraignment, a court official said Monday.

Libby, who was indicted on Friday on charges of obstructing justice, perjury and making false statements, has promised a vigorous defense.

As part of his strategy, Libby is expected to argue that any incorrect information he provided to federal investigators or the grand jury was the result of lapses in memory, rather than intentional lies, according to Libby's lawyer and other attorneys involved in the case.

From the victim of several depositions--the first thing a good lawyer will counsel you to do, if there is any doubt as to the accuracy of your recollections, is respond:

"I don't recall."

Libby is either very stupid, has bad counsel, or is an arrogant prick who thought he could get away with trashing a political opponent (we can rule out the first two).

Why the tortured explanations of his thinking at the time? Where did all that come from? From his faulty memory? Oh, Your Honor, I'm sorry, I erroneously recalled that at the time I heard Plame's name I thought, 'wow, this is the first time I'm hearing Wilson's wife is CIA.' That whole elaborate story is just a figment of my faulty memory.

9. Cheney made Libby donate arteries for another bypass
They couldn't take a graft from Cheney's own legs (you know, his knees are having heart-attacks too) so Cheney ordered Scooter to give-up a few inches of arteries from his leg.

What, wouldn't you do that for YOUR boss?

enter a plea at the arraignment on Thursday or does that come at a later hearing?

12. He'll probably be asked to enter a plea
But the initial arraignment is to set bail, if any, and to notify him formally of the charges against him. And of course, to give him an opportunity to run into the courthouse with a raincoat over his head.
