Just a theory ...

How can you prosecute a leaker if you don't know who is telling the truth and who is not? Fitz spent the last two years trying to figure out who was lying. By the time he got his answers, the GJ expired. So Libby takes the fall. There's no way the Bushies will allow this to go to trial because too many members of BushCo will have to testify under oath. Libby will either be pardoned or be suicided.

8. He lied because he knew Plame was undercover
Libby spoke with government officials SEVEN TIMES about Plame prior to outing her. He was obviously researching her situation at the CIA. He even told a colleague that it's not appropriate to discuss her on a non-secure telephone line. That's because he knew she was undercover, imho. So, after he got caught outing Plame, he lied to the FBI because he feared he would be charged with the very serious crime of outing a CIA agent.

I'm peeved that Fitz refused to charge Libby with outing a CIA agent when it's clear to me Libby is guilty of that.

13. He has to prove specific intent and knowledge, beyond a reasonable doubt.
That's a tough burden. But the investigation is over, and if sufficient evidence surfaces, I should think additional charges could be brought by another GJ.

I've read part of the statute you cited. I disagree with all the pundits who say "it's difficult" to prosecute. Gimme a break! Fitz has evidence that Libby knew she was undercover. CHARGE HIM and let the jury decide the issue.

19. Um, no; it's the law.
The burden of proof doesn't appear in the statute itself; it's a requirement in any criminal prosecution: the government has to prove all elements of the offense beyond a reasonable doubt. And no prosecutor will charge an offense that he isn't sure he can prove by throwing a charge up against a wall just to see if it will stick -- in other words, just letting the jury decide even if you don't think you can prove the case -- is a sure way to set yourself up for a claim of malicious prosecution. A guy like Fitzgerald would never try a case he wasn't reasonably sure he could win.

24. He has. Fitzgerald enumerated 5+ instances, from multiple witnesses,
in which Scooter was speaking of Wilson's wife as a CIA agent, but before the time that Scooter told them he learned of Wilson's wife from Russert.

To entertain the doubt that Scooter somehow didn't remember all of these instances as happening BEFORE his speaking to Russert is certainly beyond reason.

Fitz has that fucker by the testes.

Back when he was lying if you will remember, the bush administration was cock of the walk. Nobody questioned them, nobody could touch them, their actions went uncontested. This created arrogance. They thought they were bulletproof. This is what caused the lying. Libby really believed they were the untouchables. Little did he realize that years later this would all come back to haunt him.

he said he got the ID from reporters. Now take ANY OTHER possible story---"I got it from Cheney", for example--and realize that it just opens up tons of questions, like: "why? what were you expected to do with this info? Where did he get it from? Why did he get it? Who else did he share it with? Who else was in the room, on the line? What did you say when he told you? What did he say in return?"

Scooter picked the one story that simply did not stimulate andy further questions to be asked of him or anyone else at the WH.

That's why. Now, did he know the ANSWERS would show criminal intent? Or did he just want out of the GJ room?

They've said she wasn't under cover since this broke, we need to make sure they don't weasel out of that. Because if she wasn't under cover, that's all Scooter had to say. He lied which proves he was covering up because she was under cover. And it is possible he lied to protect his own ass, pure and simple. He really could be the one that did this. In any event, it doesn't hurt to yammer incessantly about Libby never doing anything without discussing it with Cheney. What did Cheney know and when did he know it.
