Can it be? Abu Ghraib Photos to be released Wednseday??

"As part of the FOIA lawsuit brought by the ACLU, a federal judge recently ordered the Defense Department to turn over photographs and videotapes depicting the abuse of prisoners held by the United States at Abu Ghraib. That decision has been stayed until October 26. The government has not yet indicated whether it is going to appeal the court's decision."

yeah i know it's rawstory, (not that i have a problem with that) but it seems to be based on info from the ACLU.

I have always found them utterly reliable. I may be positively biased toward them, but all of a sudden people are acting like they are Tom Flocco! What did I miss?

14. i'm not sure, that was just being pre-emptive. i keep hearing it's the
Matt Drudge of the left. And it posts teasers saying "developing story".
i don't have a beef with them, but others here certainly do.

7. We may get the indictments, but we aren't going to get these pics.
The indictments have the entire country in an uproar. The pictures would set the whole planet into a tizzy. They can't afford it.

But I certainly wish it would. It would be our little 'trifecta'. (Rove, Libby, and the pics.)

Thanks to them for persistently fighting for our rights and for the information to be made public.
Tomorrow will certainly be interesting.
I wonder if these will finally be released or if the Defense Dept. will stall once again.

10. They're going to allow the photos to be released?
Why now? They've been fighting so hard to keep them hidden.

Could it be that the charges against them will be worse than we thought and they need something HUGE to distract the people and the media? Could the photos be the diversion for tomorrow? :shrug:

12. I think it was accidental that both are falling on the
same day. The DoD didn't think indictments would be the order of the day when they asked for an extension last month.

the fact that they haven't filed an appeal is not. They knew when the GJ expired ... and they knew when the photos were ordered to be released.

That's not crazy talk, that's a fact- it's just been super underplayed in the MSM...

You should read the judge's order. He displayed real courage.

In the court order, he gave the DoD 20 days to appeal. How that translates to Oct. 26, is beyond me... My guess is, judging by their track record, they will wait until the last second, then appeal. But we shall see.

28. I'm of the opinion that the McCain torture bill was a CYA move on the part
of the Senate, specific to the unreleased Abu Ghraib material-- if and when it breaks. Keep in mind most of Congress have actually SEEN the stuff we haven't been allowed to.

the press finally reporting, stugg coming from amnesty about deaths in these jails.
i think they know it's going to be an issue, and people will be outraged they knew.

That judge could have ordered the photos to be physically in the courtroom the day of the decision, and handed over immediately.

I do appreciate the seriousness of drawing the ire of the beast by ruling for the photos to be released, but true courage would have ensured that they were released.

19. Every appeal they have filed has come at the 11th hour
It is a tried and true tactic for Bushco. Wait until the last possible minute and then use some of them there lawyer folk you claim to despise to give you a few more months to cover your crimes.

Every last one resign in disgrace...every last one.

23. Assuming they appeal, it's still not over- this is a long haul fight
when Judge hellerstein ruled against them, though, they lost a REAL big battle.

36. Here's a copy of the Judge's Order - calling for release on Wednesday
He extended his order for a few days to give the government the opportunity to request reconsideration of certain parts of his Order from September 29th. Unless the government responds, the release of the photos and videos must occur today on Wednesday, October 26th.

CourtWeb, unfortunately, can sometimes be a bit slow in posting opinions and orders (and Judge Hellerstein doesn't always use it, anyway). CourtWeb would also not show any filing by a party, such as the notice of appeal. Having said that, a review of the docket on the PACER/ECF database (registration required) shows that, on Monday October 24, the ACLU filed papers in opposition to the CIA's motion for partial reconsideration. Later that same day, Judge Hellerstein signed an order further enlarging the stay, until November 1 to permit him time for consideration of the government motion and plaintiff's opposition. So sit tight everyone, we've got at least another week to wait.
