22. What about another possibility?
This occurred to me when a friend of a friend recently had surgery for kidney stones: they found something else more serious. Another person I know had his gallbladder out and a routine check revealed liver cancer as well. Apparently when various proceedures are done (help me medical people...) other things show up due to tests that might otherwise not be done or from "looking around"

Seriously, perhaps he is still recovering or under treatment for something?

But, I've had doubts about even his severity of his kidney stones to be honest. They used that as an excuse for his absence during Katrina when the truth is he was at Camp Casey the Tuesday after Katrina hit giving hugs to the bush* supporters there.

At one point I was wondering if his absence was punishment for him letting bush* down during Katrina by still being focused on Cindy.

Whatever the reason, he has been missing at times when he would usually have been at the side of bush*.

Give the accused yet another opportunity to appear before the Grand Jury -- provide more info, cut a deal (save your ass implicate others etc)

CNN said earlier that Rove's atty is denying he received a target letter but now I think I just heard Paul Begala say Rove DID receive one...I have no idea but I hope that ugly f*** goes down in flames.

busting a gut. Brownback is apoplectic, Lott says he won't bow down and scrape, and that there are others FAR MORE QUALIFIED. The Dems are simply saying they want some serious questions asked. The GOP will get their nomination if they only stick together, but they aren't doing that.

Who knows, maybe Monkey will slide Gonzalez in, and give the AG job to his gal Harry...

Kidney stones are supposed to be extremely painful, and I pray that he has many large ones that are difficult to pass and are inoperable.

I've never heard of this.

Live and learn. This is what I get for staying away from Federal grand juries.

But, if Rove got a letter now, at the end of the grand jury's term and the investigation, that's really begging the point. Who hasn't retained counsel? It's Washington - where everyone knows to get a lawyer, if they haven't already.

I'm not buying it, not in this situation, not at this point in the investigation.

A: Federal grand juries conduct investigations into possible violations of federal criminal law. They have the power to subpoena witnesses to appear before them to testify and produce information.

The Department of Justice has special policies when the subpoenaed person is either a “target” or a “subject” of the grand jury investigation. A “target” is someone the prosecutor or grand jury has substantial evidence to link to a crime, and who, in the judgment of the prosecutor, is likely to be indicted. A “subject” of a grand jury investigation is someone whose conduct is within the scope of the grand jury’s investigation.

Due to the potential for unfairness and misunderstanding in making a person who is likely to be indicted testify or produce documents before a grand jury, prosecutors must first attempt to get the target to voluntarily appear. If that doesn’t work, the prosecutor must get the approval of the grand jury and the United States Attorney or the responsible Assistant Attorney General in order to issue a subpoena.

In deciding whether to subpoena a target, prosecutors will consider the importance of the testimony or information sought...If the target of a grand jury investigation is subpoenaed, it’s the policy of the Department of Justice to advise the witness of his or her rights, either by attaching an “advice of rights” form to the subpoena or in a letter than accompanies the subpoena. In the case of a witness who’s the target or subject of the investigation, the following advice is provided: “The grand jury is conducting an investigation of possible violations of Federal criminal laws involving: . You may refuse to answer any question if a truthful answer to the question would tend to incriminate you. Anything that you do say may be used against you by the grand jury or in a subsequent legal proceeding. If you have retained counsel, the grand jury will permit you a reasonable opportunity to step outside the grand jury room to consult with counsel if you so desire.”...

who handles criminal cases, and he knew all about target letters.

I never cottoned to criminal law. Civil, for me, was much more interesting. A whole different set of problems, and not all that many criminals.

this indeed would seem an indication that he's going to be indicted and to "get his things in order" before they actually hand him the indictment. Why do they coddle these pricks and give them ample time to prepare is beyond me. Do ordinary citizens get this sort of treatment? Hell no! They're dragged from their homes in the middle of the night, given their one damned phone call, printed, photographed and locked up. Turd-blossom deserves nothing more or less than anyone else should expect but his doughy, pompous, evil ass is being coddled like he's "special". He's a common criminal, no, WORSE. He's a traitor to his country and doesn't deserve even the slightest courtesy. I say, go Abu Ghraib on his ass! :grr:

Target Letters: Terminology


I'm beginning to see some people, including at least one news service, misapply the term "target letter." Just so it's clear, a "target letter" is what the prosecutor provides to a witness who has been subpoenaed to testify before the grand jury. It is an advisement of rights, particularly the right to counsel and the right to not testify.

Once the investigation is complete and the grand jury has heard all the evidence and is about to return Indictments, target letters are no longer used.

If Karl Rove's lawyer, Bob Luskin, is still as easy to read as he has been since I broke the story that his client was Matt Cooper's source, then we now know that Rove has received a target letter from Patrick Fitzgerald. How do we know it? Luskin refuses to deny it.

Fitzgerald does not have to send Rove or anyone else a target letter before indicting him. The only reason to send target letters now is that Fitzgerald believes one or more of his targets will flip and become a prosecution witness at the pre-indictment stage. A veteran prosecutor told me, "If Fitzgerald is sending target letters at the end of his investigation, those are just invitations to come in and work out a deal."

Rove would not go back to testify in front of that grand jury if it wasn't. This is what, at least four times in front of the grand jury for him now? And every time he goes back it just provides more and more to build a perjury case on.

These are issues of National Security and folk like Fitzgerald, the Judges who've ruled and the Grand Jury take that type of stuff seriously.

Before very much longer, the hinges are going to be blown off this thing and we'll then see just how big this is. I'm all for lowered expectations as a way of meeting disappoitment halfway, but this situation is a big, big deal - all the signs are there.
