Officials Want to Retry Woman in Death of Toddler

Officials in the Perry County Prosecutor's Office says they will
attempt to try a woman again after she was freed from prison after an
appeals court ruled in June that the wording was incorrect on her
indictment.

Donna Conley served about two years of a 13-year sentence for
involuntary manslaughter and child endangerment.

Her 4-year-old stepdaughter Brandi Conley died in 1996 of a brain
injury, which doctors say was the result of battery.

The 5th District Court of Appeals in Columbus threw out those
convictions because Conley's indictments did not include a charge thatshe had acted recklessly, which was required.

1. Does this classify as double jeopardy?
Can you be tried for the same crime twice?

2. No, but only if the jury found you not guilty. Since
she was found guilty, it's not double jeopardy.

3. Ok, thanks. Is this common?
To retry someone ofter an appeal is granted? I guess I have never heard of that actually happening.

4. When the appeal was on a technical issue...
and when the technicality does not damage the body of the case, and the witnesses still live to testify, they usually do re-try. And they should. If this woman killed that baby, she deserves prison.

6. CNN said her Ex-husband helped push this matter forward. She is guilty and
needs to be imprisoned for at least the 13 years.

She didn't only shake the baby, but she or someone, had physically hit it very previously to the death, according to the autopsy.

What a sick POS this woman is !
