Physician who told Cheney to go F*ck Himself Lost his Home in Katrina,
Dr. Ben Marble, a young emergency room physician who plays in alternative rock bands and does art on the side, needs our help. Since he was the one who told Dick Cheney to "go fuck yourself" on Sept. 8, that's the least we can do.

Marble is a complex guy, to say the least. Some of the lyrics he writes can be considered harsh by some – personally what I've heard is very much on target - but he has a softer side as an organizer of breast cancer fund-raisers, not to mention an ER doctor.

1. The smarter people are...
The more complex and quirky. I don't have a problem with any of his art or music... and I've never seen or heard any of it:) Too subjective anyway and shouldn't be used to judge the artist.

There was a collective "Whoooooo Hooooooo" that went out when those words were shouted! We wondered if he was a DUer or just a kindred spirit:)

4. He said the military police handcuffed him, detained him
Posse Comitatus doesn't allow anyone but state and local police and National Guard to detain individuals during martial law. The idiots who cuffed him were just trying to humiliate Marble, and probably breaking the law too.

9. Public profanity is prosecutable in some states. . .
there was a widely-reported case a few years back in Minnesota, I believe, some guy who cursed a mean streak when his canoe upended, and a family that was nearby pressed charges against him.

13. That was in Michigan, close to where I live.
He swore a blue streak in front of children of religious folk. When they asked him to stop swearing - he added new ones.

24. Marble statement could be reasonably understood as "fighting words"

under the Cohen v. CA ruling and, thus, unprotected speech. The difference between the two cases: the words on Cohen's jacket were directed towards any specific person where Marble's were. Whether or not Marble's statement was likely to create an immediate breach of the peace is probably a matter of dispute that will have to be settled in a court. That standard would have to be demonstrated by the prosecutor for a conviction.

Nevertheless, I applaud Dr. marble for speaking out and will gladly contribute to any legal defense fund!

26. It's true that it does vary state-to-state.
However, good for the doctor for having the courage to say as much, in public nonetheless. It serves the Dickhead well to tast his own words.

the dick said the same thing to a senator on capitol hill. if they try to charge marble with this, the hypocrisy will be unavoidably obvious. i think at this point even the mainstream press is ready to start calling the administration out when they try to pull this kind of crap. it would be impossible to prosecute anyone for telling cheney to go fuck himself without it turning into a trial of cheney himself. i don't think the administration can handle that kind of bad press right now, and i bet they will tell local authorities to steer clear of such cases.
at this point i think anytime, anywhere, cheney makes a public appearance there should be people all along the motorcade route and outside the speaking venues (they will no doubt not have him speak before an uncontrolled crowd again) shouting out to the big dick what he can do to himself. he set the precedent, let him live with it.
