My friend is killed : Hit by a robbery get-away car at the mall.
Edited on Wed Jun-08-05 09:44 AM by liberalnurse
He was at the Mall shopping with his aged mother and girlfriend. John was always a man who would help a friend out of a jam just for the adventure, a little impish, a rebel, a biker, a successful farmer, a prankster, a Patriot, a Democrat, a beloved friend to me.

His family is renoundly know since they owned one of the larger farms in the north end of Clark County. His father use to work at the local hospital for health insurance and to pay his farm taxes. These girls are in deep shit!

SPRINGFIELD, Ohio -- A massive manhunt for four women continues on Wednesday morning in Springfield.

Authorities said the women are accused of shoplifting from the Macy’s store at the Upper Valley Mall and then, during their getaway, hitting a pedestrian in the parking lot. The pedestrian died from his injuries.

Police said three women took several clothing items without paying for them from the store on Tuesday. Authorities said the women ran to a fourth woman who was waiting in a getaway car in the parking lot.

Investigators said as the women made theie escape, they struck a pedestrian, 49-year-old John Deselem, of Springfield, in the parking lot, who later died from his injuries. The women then fled the scene and crashed their car in German Township and fled the scene on foot in a nearby wooded area.

Deputies from Clark County searched the car and discovered it had been reported stolen from Columbus from an Enterprise Rental lot.

49-year-old hit by car carrrying 4 accused of shoplifting
By Kelly Baker

Cox News Service

GERMAN TWP., Clark County | Four women accused of shoplifting from Macy's in the Upper Valley Mall on Tuesday fled in a stolen car that struck and killed a Clark County man as he stepped off a sidewalk leading to the mall's parking lot.

John Deselem, 49, was killed when the sedan struck him about 3:45 p.m. His mother and his girlfriend saw the car hit him, according to deputies.

"They hopped in the car, and the car sped away and hit a man in the parking lot."

Witnesses were able to get a license plate number to the car, which was traced to a stolen rental out of Columbus.

Surveillance video from Macy's showed four women believed to be in their 20s wandering through the men's section of the store.

The women, carrying arm loads of clothes, got into the car, which sped off.

Amazing that something as stupid as shoplifting could lead to this.

I wonder if this could somehow be shoe-horned into a felony murder charge against the women.

55. Update......they have identified at least three of the women.

http://www.whiotv.com/news/4584161/detail.html

SPRINGFIELD, Ohio -- Authorities in Clark County said they have identified three of the women who are accused of robbing a Macy's store in Springfield Tuesday and hitting and killing a pedestrian during their getaway.

Three of the women who were seen in surveillance video allegedly shoplifting from the Upper Valley Mall have been identified. Sheriff Gene Kelly said they are a part of a group that stole thousands of dollars' worth of clothing.

Authorities said the women ran out of the store, into a waiting car and then struck and killed a pedestrian. Kelly said a car chase between the women and authorities ended in a crash in German Township.

Investigators said the women then bailed out of the car into a wooded area on foot. The search for the women continued overnight in the wooded area and in Columbus, where police said the women are from.

Deputies said they got the break in the case with some help from authorities in Columbus. They said the women reportedly stole a car from a rental company and traveled to Springfield.

Kelly said they hope to identify the women who was driving the car. He said hopes to get arrest warrants sometime on Wednesday.

IIRC, Ohio has a death penalty. If this gets much attention and the local DA is up for re-election next year, the DP could be sought in the case.

I believe the murder needs to be pre-mediated for it to be a death penalty case. Regardless, it's a horrible thing that had happened to this poor guy.

Not sure there is another felony here though. At least not a felony that triggers capital murder.

But I don't know Ohio.

51. Neither do I. If there is a felony
it would be the fleeing the scene. I would also suspect teh dollar value of the merchandise stolen will probably rise to the level of felony. There actually might be multiple felonies in addition to the murder.

40. Of course, it depends on the type of crime committed
I doubt shoplifting is a felony unless they were violent or stole above a certain dollar amount.

Though it's probably a bit crass to turn this into a law school hypo. (Even though I did it first).

I will say that the girls may have gone from a few weeks in jail to a few decades.

46. At the very least
It also depends upon the other crimes involved, too. Proscutors generally tend to rack up the charges because that usually leads to a plea bargain and no court time. Of course, high profile cases will almost always not have anybody plea out.

and didn't try to conceal the stolen goods--THERE'S your premeditation. A charge of robbery rather than shoplifing would be felonious enough. Getaway drivers in bank robberies aren't charged or punished less because they kept the motor running while their partners did the actual robbing.

My condolances to you and your friend's family.

69. Just let me know, I'll play Battle-Taser with you whenever you want.
Just be sure not to try to ignore your feelings and be sure to get rest. Your body kicks in to that numb state as a safety mechanism, the body's own sedative to help deal with the situation. Just take things easy and take care of you. :pals:
