Can WE sue Diebold???
Edited on Sun Sep-21-03 05:50 PM by gully
Democrats who voted for Gore that is? We've all been disenfranchised!

Any attorneys wanna take this up? This may bring media attention.

Thoughts?

1. Shouldn't we be able to sue them on constitutional grounds?
As in they won't show what their code is? So that it's not open?

Elections are supposed to be done by a process that's open, is that not so?

Anyone else?

Anyone want to take up a class action lawsuit?

They've had enough snafus already, in Georgia and Nebraska, am I right?

2. no
courts have already ruled that a company's code is proprietary and may be kept secret.

Perhaps there's a chance for civil rights violations, but I believe that the NAACP already settled the cases they had going in Florida.

5. But...
AOL was sued for providing lousy service. It seems to me there must be some legal ground?

6. It is only proprietary until they try to break the law...
then they can no longer hide behind the law.

4. Go for it
I'm not a lawyer, but I believe there's a lot of different things that Diebold can be sued for. The trick is finding the right attorney -- i.e., someone who will do it, whatever "it" is.

7. Precisely,
You have to find an attorney experienced in election law, a venue to sue from, and ground for a suit supported by the venue.

Then you have to find the money to pay the lawyer.

I'd try for a GAO investigation instead.
