Justices Agree to Hear Appeal on Parental Notification Law

The Supreme Court will hear arguments in the case in the fall.

WASHINGTON (May 23) - The Supreme Court said Monday it would take up a new abortion case this fall, raising the political stakes just as the court faces the possibility of replacing ailing Chief Justice William H. Rehnquist.

The justices, in agreeing to review a parental notification law from New Hampshire, showed surprising zeal to take on a divisive subject - especially considering the uncertainty of the court's future and the partisan fighting in the Senate over President Bush's nominees for federal judgeships.

The last major Supreme Court abortion case splintered the justices 5-4. A similar split could occur again, with or without Rehnquist, with additional drama outside the court.

''It is a bold step to take the case, bold in a political sense,'' said Douglas Kmiec, a constitutional law professor at Pepperdine University. ''It may well be the court's way of reminding the president there's a lot at stake in a Supreme Court vacancy.''<snip>

4. Given the current make up of the Court,
I'd wager that they'll uphold the notification laws. O'Connor might go along with keeping abortion legal, but she's also voted in the past to uphold restrictions on the access to services. Unlikely that anything good can come from this.

5. Too much at stake...
I'm so worried that we're turning the clocks back and my daughter is being given a world where she is a second-class citizen. I think the Rehnquist's replacement won't change the make-up of the SC, but this is setting the stage to keep the base riled up and make sure the Rethugs don't lose seats in '06, since the ruling won't come until next year, well into campaign season.
