Reid just said in the Senate, "All filibusters are extraordinary"
in response to Frist's statement which consisted of repeated threats to go back to the nuclear option if Dems filibustered nominees. Reid said "the nuclear option is dead. Let's recognize that and move on."

I think Frist was just whacked upside the head.

4. It's possible that this deal was exactly a sign from the moderates
that Frist is not the boss of them, that he cannot count on them to support the nuclear option and therefore the nuclear option is dead.

If that is true, however, why the fuck would the Dems give in on the judges they filibustered for four years? Why didn't they force the Republican mods to choose insanity or reality?

7. Maybe there is more to the deal?
Last night Graham strongly hinted that at least one of the 3 may not be confirmed in the "up or down vote". If the moderates want to really send a message that will stick in the wingnuts' craw they could vote down one or more of them. Then all hell would break loose.

He's gotta be thrilled. He's leaving the Senate to run for President. Since this did not succeed, nobody will remember this besides the RW whackos that will sign up to be his loyal foot soldiers in the 2008 primaries. To the moderates this will be a forgotten episode, and he can appear professional and reasonable enough to pick off some Wall Street Republican votes, and he has the fundies all but locked up. Off camera, he's probably peeing his pants he's so happy. It's like Thomas Frank says, assholes like Frist win by losing fights like these.

8. Reid Looks Like The Fox In The Henhouse!
This man showed me he could play poker with the best on "The Strip".

Frist was not just ready to pull the trigger...he looked like a kid who got his gun taken away. Reid, meanwhile came out as "I knew we could do this".

Reid knows how the game is played now and without getting the 3/5ths rule waived, he can, and will force Frist now to rethink how he's gonna run these nominations and how much floor and debate time he can afford to use. Frist was hoping to ram each of these through and this game would have been over...Reid holding his rectum. Instead the tables are turned.

Reid even upped the ante, mentioning there were two judges he could "up or down" right now. He's put the pressure on Frist to junk Owens for now and then rethink who he's gonna run up the next time.

And, of course, if one doesn't think any nomination to the Supreme Court...especially for Chief Justice, isn't extraordinary circumstances, what planet are they on? No way in hell would there be a simple majority on that nomination. Specter, Warner and other moderate Repugnicans saw the extreme danger in that.
