Just a thought, I just realized HOW the entire Judge situtation....

The judges serve in a lifetime appointment IN THEIR ASSIGNED COURT do they not???

NOW.. just hang with me for a minute...

it's 2008, we've managed to take back both the House/Senate and the Oval Office.

The judicial system is vasty overtaxed and overloaded (I don't think there is arguement there...) and we could really stand a

JUDICIAL REORGANIZATION.

Simply draw NEW JUDICIAL CIRCUITS, replace each and every one. Double the number of circuits.

OOPS... those old COURTS don't exist any more.

Gee Whizzers... guess the President would have to appoint ALL NEW JUDGES..

just enough 'old repukes' to keep them in the minority (and prevent them from screaming that we are 'stacking the deck' ) and spanking fresh 'progressives' for the rest...

Would it work?

When were the 13 circuits established...Who has the authority to change/eliminate ONE or TWO?

the trick would be redrawing them, eliminating/increasing them so that NO EXISTING CIRCUIT would be within a NEW CIRCUIT, hell even call them something different... instead of the 9th Circuit call it the "Western Second Circuit" so that there is ZERO arguement that the old entities exist.

organization for over 100 years... in fact I'd hazard to say some of them since oh 1789

4. Congress Can Do What It Wants with Federal Court System
Article III Section 1:

"The judicial Power of the United States shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish."

The Judiciary Act of 1789 set up the system of federal appellate circuits and district trial courts. Congress can change it anytime 218 Representatives, 51 Senators and 1 President say so.

and who could complain with anything that could aleviate the overloaded court system???

8. In a sense
that is comforting, because we're going to have a lot of work to do. Not only in rectifying all of *'s fuck-ups, but also in fixing the system so that this mess doesn't happen again.
