A serious question in regards to this deal
If Bush nominates either Owens or Brown for the Supreme Court, how do we justify a filibuster? If we let them go now, then it seems we would have to let them go for that too.

we could point to all the disappointing rulings they've made in district court in the interim? :shrug:

2. actually appeals court
and that might work, especially in the case of Owens who seems to have no redeaming value. Brown on the other hand is good on some issues and could well be used on those kinds of cases to butress her record.
