The point of all of this was to protect the public from owen. It wasn't about anything else until those bastards changed the terms of the debate. Now, for some reason everybody seems to be happy that they have "given" us something less than we already had, and owen gets in. To my way of thinking we have been steamrolled again.
2. No, if we had filibustered, the rules would have been changed and
they would have gotten through. We can slow down the senate in the process, but in the end all of them would get through by eliminating the filibuster.
6. The Fifth Cir. is so conservative that this does not matter
I practice in the fifth Circuit. The Fifth Cir. is so conservative now that Owen really does not matter. She is no worse than many of the existing justices on the Fifth Cir. Getting Owen of the Texas supreme court may be of some benefit. She and Nathan Hecht were an effective team in getting some conservative decisions through.
The dems were blackmailed on this and they had two choices get balls and let the Repubs blow up the Senate (Metaphorically speaking Mr FBI man) and then just SHUT THE PLACE DOWN! Use every procedural trick in the book to make the Senate irrelavenat for it would be anyway. Lieberman plays the peacemaker but in reality he is just a pussy and just wants to go along to get along. I WISH THEY WOULD HAVE SHUT THE MOTHER DOWN!
The second choice was to KIss Frists Butt and the dems took the easy way out by choosing to kiss Frists BUTT! What a bunch of pussies!

Despite all the spin, the Dems sold out..again. There is nothing to prevent the repugs from resurrecting the nuclear option again at the first sign of a whimper from our heroic "leaders". Which is an unlikely event.
