Exactly what are the "extraordinary circumstances" which would allow Dems
to filibuster Bush's picks for the Supreme Court? According to the newly announced "deal", Dems will not filibuster unless it is an "extraordinary circumstance"? what? that the person is a child molester--then it might be ok?

I'm not saying it's good or bad, I just want to know more about the specifics.

I think the glut of RINOs and DINOs are the sole arbiters of whether or not the circumstance is extraordinary. God only fucking knows.

hardly concise legal terminology. Feels like we're back to square one!

4. Extreme Circumstances-Scalia or Thomas as Chief Justice
I would define extreme circumstances as either Scalia or Thomas being put for Chief Justice when Rehnquist retires. The term is vague enough to give us some wiggle room.

I personally believe that it will be more difficult to pull off the nuclear option for a supreme court nomination.

""extraordinary circumstance" -- is a hurdle no minority party will ever clear and, thus, on May 23 2005, that which our founders recognized as the essential 'checks and balances' of power has been neutered.

6. IMO, that's the good thing -- they didn't define the term.
So they can call it anything they want. And in this administration, it's all extraordinary circumstances. They can make a very credible argument that nominating a wack job like Scalia for Supreme Court CJ is extraordinary. I don't see any real restriction on future filibusters, because the reality is that judicial filibusters were only ever used rarely -- in extraordinary circumstances.

Bushes radicals will now get an up or down vote so the 7 ass-clowns get approver. Then when a supreme comes open and we say filibuster, they say no anc vote to change the rule. We lost, plain and simple. We are an unworthy minority with no kahunas and this really hurts out chances big time in 2006.
