33. It is supposed to require a super-majority (67 votes) to change the
Senate rules but the Republicans are going to break the rules and say, nope, only 51 votes needed instead of 67. The Senate Parliamentarian disagrees but they wont ask him and will just do it instead.

That is how they are going to break the rules to change the rules.

48. Wrong.
A rules change requires sixty-seven votes to pass.

This will be done as a ruling from the Chair declaring the filibuster of judicial nominations to be either (A) unconstitutional or (B) in violation of existing Senate rules. It is the ruling from the Chair that only needs a simple majority to be upheld.

My guess would be that Specter is number 4. We need two more. I don't think we can get two more though. I just don't forsee Warner, Collins or DeWine having the guts to cross party lines on this. Graham might have the guts, but I think that in the end his ideological leanings will win out over his concerns about process. Hopefully, I'm wrong.

On edit: I wonder why Hagel is not on their list?

WASHINGTON - Sen. Mike DeWine of Ohio, who has emerged as a key Republican holdout in a congressional battle over whether to end judicial filibusters, is getting pressure from both sides over a pivotal vote that would make it easier for President Bush to get his nominees approved.

The Senate could take up the issue as early as Tuesday if lawmakers vote on Texas Supreme Court Justice Priscilla Owen, one of several controversial nominees Democrats threaten to block with a filibuster, a stalling tactic intended to thwart votes on nominees or bills.

Shut the damn government down like the Republicans did back in January 1996. Enough is enough. It's time to come out swinging and if the Republicans will go this far then we must go even further to save the Republic from them.

43. IMO, we should all help. A 2 day national general strike
by all Democrats and anyone and everyone else genuinely concerned about regaining democracy in America.

We can take the "torch and pitchfork" option.

This is pure speculation, but is this a Rovean move to try to showcase the Democrats as "roadblocks to getting the nation's work done"? If everything is shut down because of Democratic opposition to the nuclear option, then I would think Rove would market the h*ll out of it -- and pimp it for everything it would be worth in the '06 elections.

47. Wow. Who knows where this is headed?
First it's important to note that this all could have been avoided if Bush had simply chosen to appoint moderates acceptable to Republicans and conservative Democrats. Bush is the one who wants to do away with advise and consent. He wants to shove these extremists down the Senate's throat.

How long will the Democrats go on retaliating by asking unanimous consent on everything? At what point will the Republicans use parlimentary tactics to do away with or circumvent other Standing Rules that get in their leadership's way? Who will back down first? I wish I could say for certain that it won't be the Democrats who will blink this time.

Most likely Specter. Specter is very ill, and he's not a fan of overturning the filibuster, but the Administration is holding the chairmanship of the Judiciary Committee over his head. As sick as he's been, he may just vote his conscience.

50 Senators loses this one. We need a higher level because at 50 Senators, Cheney casts the deciding vote.
