Frist's "nuclear option" is NOTHING compared to the "Thermonuclear Option"
"What's this thermonuclear option you speak of, Walt?"

Why, it's laid out in Article III, Section 1. of the constitution!

"The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office."

The thermonuclear option is simple. The Congress pulls the plug on all District and Appellate courts in the land, stating we don't need them any longer. After that, they begin the long arduous task of creating new inferior courts as they deem necessary to ordain and establish.

Now the Pretzledent can appoint whomsoever he wishes.

Think they won't do it?

It all comes down to the '06 elections. If they gain seats, count on the thermonuclear option.

The radicals on right wing blogs like the Freakers are already demanding this.

1. I've already heard some talk about this
about the courts in general but specifically in regards to splitting the 9th Circuit Court - they have a particular hatred for it.

why all those drug dealers & other federal crime offenders are walking the streets out on bond instead of being locked up....and I don't think the Supremes are gonna like hearing ALL the federal civil & criminal cases.

It is true that the feds throw most of the burden on the states to prosecute some of these federal offenses, but I think most if not all are going to start doing what my local county does: no pay, no play. We're not going to clog OUR courts & jails with YOUR cases & YOUR crooks if you're not going to pay us.

All they have to do is pick up three Senate seats and it's a done deal.

6. Delay and the house repukes have tried something similar
The house repukes have tried to abolish the 9th cir. and to limit the jurisdiction of the lower federal courts as to such matters as flag burning, the ten commandments and abortion. The Senate has so far refused to go along with this concept in part because of filibusters.

7. The corporations are the biggest users of courts
These right winger may be nut cases, but they are not stupid. And pulling the plug on all District and Appellate courts would PO a lot of corporations because their contract enforcement would come to a standstill.
