National Historic Preservation And Endangered Species Acts Under Attack

THE FOLLOWING IS A PUBLIC SERVICE ANNOUNCEMENT FROM DISTRESSED AMERICAN, ARCHAEOLOGIST AND CONCERNED CITIZEN!!!

Please keep this kicked for Historic Preservation.

The battle is in its early stages (still at the sub-committee level). But, the changes being proposed are unacceptable. This is one we can fight from the first days on.

We MUST if we care about the past being preserved for OUR CHILDREN!

As an archaeologist I am extremely troubled by these changes Proposed by Rep. Pombo (R) of California and his corporate sponsors. They represent the victory of industry over our cultural and environmental heritage!

Please take the time to familiarize yourself with this legislation. It is being sponsored by California Right Wingers with the backing of among other folks the cell phone industry.

In essence, what the changes propose would gut the National Historic Preservation Act. As it stands now, all construction on state or federal land or any using tax dollars MUST be preceded by an environmental and archaeological assessment before construction can damage the resources that might be there.

The changes proposed would in essence eliminate that provision, limiting protection to places ALREADY LISTED with the National Register Of Historic Places.

That means any archaeological remains NOT ALREADY IDENTIFIED can be destroyed with impunity!

These laws as they stand are inadequate as they do not protect resources on private property. As am archaeologist, I have worked in many other countries and am familiar their historic preservation laws. They are far more stringent. All archaeological materials in Mexico for example are protected by law.

If these rule changes pass, we will be returning Historic Preservation to the state it was in in 1965!

PROPOSED AMENDMENT TO ELIMINATE ELIGIBILITY FROM SECTION 106
The House Resources Subcommittee on National Parks, chaired by Rep. Nunes of California, is proposing amendments to Section 106 of the NHPA. Only properties listed or formally determined eligible by the Secretary of the Interior would be considered in the Section 106 review process. This would, of course, eliminate a substantial number of properties from 106, and could well have the opposite effect from that intended by its authors by the added cost of nominating sites. There are other issues, as well. For a copy of the draft amendment, click here. The Subcommittee will hold hearings on April 21, where testimony will be taken. ACRA and other organizations are working to gather information in support of maintaining the eligibility requirement. 2. As a biologist,
The Endangered Species Act is the only thing standing in the way of wholesale rape of the land in many cases!

I've been reading "The Grail Bird" about the rediscovery of the Ivory-Billed Woodpecker, and it's SO SAD to read the descriptions of where the bird was seen in 1944, old growth bald cypress swamps, with the same site today, soybean field.

If the ESA had existed in 1944 the bird's habitat would never have been cut and the bird would not have been "lost" for 60 years.

In Northern California the timber companies would LOVE to cut the last old growth redwoods in private holding, but the murrelets, owls, and salmon keep them from having their way.... for now.

There are species fighting the good fight against development all over the US!

And there are Native American burial grounds all over the US too! You'd be surprised!

I am still trying to find out how it may be impacted. I believe that those changes are a second piece of legislation by the same folks. Still looking for more.

7. The tie-in
is Big Development.

In California, the farmers and developers will destroy arc sites intentionally so they won't be hassled. I've heard several stories of people out doing biological assessments and finding bones ALL OVER that the land owners knew about and kept secret, and I've even heard stories of farmers intentionally disking/ripping sites with bones sticking out of the ground in order to conceal burial grounds.

3. We already know the Bush Administration has no concern...
...or regard for antiquities or history. Their total lack of concern for the antiquities of Iraq is only one huge example. Developers in the US that own private land will no longer have to be concerned with preserving historic artifacts or sites that may be uncovered during site construction. Republicans equal absolute destruction.

Here's a short snip:

We have ample evidence of the Bushies’ contempt for artifacts in the way they allowed museums to be looted in the wake of our invasion of Iraq. Their only concern was securing the oil ministry. Several archaeologists and/or historians quit in disgust after their pre-war advice to the Administration was ignored once the invasion had taken place. There was also suspicion that artifacts were selectively taken and may now reside in the homes of wealthy Texas Bush supporters.

11. In my humble view, this is, in some ways, even more important than SCOTUS
nominees. Even the SCOTUS nominees - with their lifetime appointments - will be gone at some point.

Once destroyed, our antiquities and our living resources can never be resurrected. SCOTUS is ... what? ... 20 years? 10? 30?

Forever is forever.

But to these thugs, they're no different than our arts. Meaningless porn for intellectual masturbators.

(In actual fact, SCOTUS is likely more important, but you get my point.)

in the lobbying effort against this? I haven't seen anything on their website. This is so incredible. To think that we were shocked- shocked when the Taliban blew up the ancient Buddhas, but now they can in essence blow up the Pueblo caves for a cell phone tower? This is awful!

getting moving on the issue. It is still early. I think some are getting ready but, just have not posted yet. I feel like it is important to fight this from the very first steps.

In the past, when I heard about early stage proposed legislation, I took a wait and see attitude. With these guys controlling all 3 branches, I no longer make that mistake.

I am e-mailing this out to my friends/family, etc. Sabo, Dayton and :puke: Coleman are going to hear from me on this. Thank you so much for keeping this kicked. Forgive me because I haven't been able to read all of the info (I am only online at work) but will this affect NAGPRA?
