Florida Girl Told She Cannot Have An Abortion
Talk about judicial activism! :grr:

A state court granted an injunction which prevents the girl from terminating her pregnancy.

She is three months pregnant and had planned to have an abortion on Tuesday of this week.

The American Civil Liberties Union says it will launch an urgent appeal against the ruling.

That would be a tragedy.

15. I am sure that if Noel Bush found herself with an unwanted
and/or unplanned pregnancy as a teen, she would have been allowed to have an abortion. A Bush would not carry a baby to term as a teen that's for sure and there is no way they would have allowed anyone not of the royal dynasty to raise a child with Bush DNA.

24. Don't forget
Edited on Sun May-01-05 05:51 PM by FreedomAngel82
what happened with George and his girlfriend. He was dating before he met Laura an African-American girl and he got her pregnant and they couldn't have that so they arranged for her to have an abortion when that was illegal in Texas. In 2002 she was going to start talking about it and she was murdered.

And this is BEFORE the chimpster gets his wish-list of judges. I wonder what it will be like if he succeeds?

5. If Fl state law does not require parental consent, then doesn't that
mean that the Law says she is capable of choosing?

I can't see this standing up to an appeal.

6. Actually,...
Since she's a ward of the State of Florida, and there is a law on the books that says that DCF does not have the authority to give that kind of authorization as legal guardian, she is in some legal limbo. This should have been cleared up long ago, but it never gets addressed down here in fundieworld. DCF is just covering thier asses on a legal front at this point, regardless of anyone's moral viewpoint. I know one thing, nobody working for the State of Florida is willing to put their neck on the chopping block for any reason, good or bad.

Of course, the fact that she was missing for a month, then they didn't even know she was pregnant until late into the 2nd trimester is another story that just clarifies the total ineptitude of the DCF down here. Way to protect the children, Florida. There's too much erring in the "erring on the side of life".

26. Actually other wards of the state have had abortions without needing
their permission. Several articles have said legal experts say she does not need their permission and so are wondering why the court is involved. There is a huge thread on this over in Breaking News here with lots of article links:
http://www.democraticunderground.com/discuss/duboard.php?az=view_all&address=102x1435415

BTW the DCF official who started this mess was the one who most recently got the state gov. involved with Schaivo's case:

Florida Agency May Take Terri Schiavo Into Custody for Investigation
http://66.195.16.55/bio832.html

A state agency may take Terri Schiavo into custody while it investigates allegations of abuse and neglect by her estranged husband Michael. The Miami Herald newspaper reported that state officials are considering taking the action so Terri's can receive food and water before she dies.

Officials with the Florida Department of Children Families indicated that no timetable had been put in place, but the idea was in motion, according to a Herald report.

Florida DCF secretary Lucy Hadi told the Palm Beach Post newspaper that her staff is relying on a state law giving authority to intervene on behalf of a vulnerable adult "suffering from abuse or neglect that presents a risk of death or serious physical injury."

Hadi said a petition must be filed with local courts to remove Terri from Woodside Hospice, where she lives, but that the agency could remove her without approval if it feels such action is warranted to protect her life.

8. Cruel
The American Civil Liberties Union's executive director in Florida, Howard Simon, said forcing a 13-year-old to carry on an unwanted pregnancy to term, against her wishes, is not only illegal and unconstitutional, it is cruel.

Cruel?? This is America, honey. Ya' want compassion, go to Europe. This is a fundamentalist xtian nation, Sweety. Don't expect anyone to shed a tear for you. Your fetus has more rights than you, 'cause you're obviously a tramp. Oh, and don't come crying to us if you can't afford to support you're new baby. Shoulda' thought about that before you engaged in that illicit pleasure. And one more thing, your baby will probably get pregnant when she's 13 which will give us the added pleasure of going "tsk, tsk" about how irresponsible the poor are, and give us more reason to cut benefits to the poor. :sarcasm:

25. Question from me
Since it's illegal to keep someone from having an abortion like that and they're forcing her couldn't they sue the state and all these people who are doing this to her?

11. I'm proud of how she's sticking up for herself. Read this:
http://bitchphd.blogspot.com/2005/04/i-love-this-girl.html

L.G.: Why can't I make my own decision?
Judge Alvarez: I don't know.
L.G.: You don't know? Aren't you the judge?
. . .
Department of Children and Family Services: The Department of Children and Families has the custodial responsibility to do what is in the best interest of the child.

L.G.: I think if I want to make the decision, it's my business and I can do that. It would make no sense to have the baby. I don't think I should have the baby because I'm 13, I'm in a shelter and I can't get a job. DCF would take the baby anyway If I do have it, I'm not going to let them take it.
. . .
L.G.: Since you guys are supposedly here for the best interest of me, then wouldn't you all look at that fact that it'd be more dangerous for me to have the baby than to have an abortion?
Judge Alvarez: A good point.

OBGYN: At her age and at her stage of gestation ... her risk of death from an abortion procedure is about 1 in 34,000. The risk of death in pregnancy is about 1 in 10,000.
. . .
Judge Alvarez (paraphrase): Who is the father?
L.G.: That's not really necessary

Is there someplace where I can make a donation toward a plane trip to San Diego for her?

I'd drive her over the border to Tijuana myself.

16. Is this girl white? I ask that because of course it is far easier to
adopt out white children than it is to adopt out black children. I suspect that if the girl is white that is one factor leading to Jebby being hardlined about this.

18. But at 13 years old for the mother
the fetus is much more likely to have birth defects (especially neural tube defects), be premature, low birth weight, more prone to being stillborn or ending up a SIDS baby.

Any and all of which will make it unadoptable even if it is white.

22. She ran away
for about a month, I guess from a foster home, before the state was aware she was missing.

Anyway, she obviously had sex. But I don't get the judge essntially wanting to punish DCF by making her wait. I don't get that. She needs an abortion NOW; the judge can penalize DCF anytime.
