"If Mr. Cheney does rule that filibusters are unconstitutional, opponents should literally run to the Supreme Court, preferably with a brief that already exists. Otherwise, a single Senate vote will nullify two centuries of sound constitutional law."
Is this in fact what could happen? Any Supreme Court that now exists or exists in the future could overrule a simple senate majority vote (of one or more) that reduces the ability of the minority to be heard can it not? Is this what the Federalists have been up to for the last twenty years, finding a clever way to dismantle the U.S. constitution?
If the Republicans or any majority party in fact can overturn two centuries of checks and balances to ensure the democratic processes of the U.S. constitution and Bill of Rights, then we as Americans have indeed been duped. That would mean that a whole new constitution and government that is responsive to all of the people in the United States of America, not just some fanatical fringe religious zealot group, needs to be formed.
