I did like this line by the reporter, though: "Linked forever to Enron as a symbol of corporate excess, Arthur Andersen was the fifth-largest U.S. accounting firm when its client crumbled, exposing illusory profits, off-the-books financial schemes and outright theft at one of the nation's largest publicly held corporations."

You do not negate law or the constitution by writing an incorrect statement in more obfuscatory terms than the original document.

3. No, think of it as a 5th amendment thing.
I agree with them in some areas. The federal prosecutors now charge people with obstruction of justice for failing to keep their own personal notes and papers which the government decides are relevant to an investigation. In numerous areas, the government now essentially forces you to be an informant against yourself.

Did you know that there is a proposal to make it illegal to encrypt your data with any encryption system for which the government does not have a key? Ever hear of the "clippper chip?" The law would require every computer sold to have a device inside which would allow the government to decode any encrypted data you might put on your computer.

These attorneys are engaged in pushing back against that kind of big-brother intrusion by government, and although its an unsympathetic case, its an important priniciple.
