1. They've been attacking it for decades
And one could certainly argue that the Judicial Branch is the only one that is really supposed to be independent. Certainly the congress is supposed to be dependent on their constituents - and since we started electing the President by Direct Vote (rather than through the legislature) he's also beholding to us.

2. yes, I thought it particularly interesting that someone said that
congress can dissolve any court they wish to, and reconstitute the court the next day. Sounds as if they want to make a bold move to get rid of certain courts and certain judges.

3. Yep. Delay made a new threat against our nation's judges.
House Majority Leader Tom DeLay, R-Texas, called Schiavo's death a "moral poverty and a legal tragedy."

"This loss happened because our legal system did not protect the people who need protection most, and that will change," DeLay said. "The time will come for the men responsible for this to answer for their behavior, but not today. Today we grieve, we pray, and we hope to God this fate never befalls another."

5. Are you kidding?
They've been attacking it through their talk radio attack dogs for years. Now with the Shiavo case, it's an all out war. I'm a little suprised they just sat there and let the judicial branch beat them like they did. I thought we would be seeing constitutional amendments to limit the power of "power crazed liberal judges". Maybe they're still coming. We haven't seen the last of attacks on the judicial branch by ledgislators, you can bet on that.

7. We Are The Only Independent Branch!
If Bush's appointment in the first place wasn't proof of that I don't know what is!

8. Two pronged attack:
1. Get judges appointed who dismantle everything from the New Deal forward.
2. Circumvent an independent judiciary with laws mandating what they review (Schiavo case) and creating ammendments when judges rule laws unconstitutional.

The attack has been going since the 80's and has picked up speed under GW. We must NOT back down.

9. They also seem willing to incite passions and violence,...
,...over their war on the judicial branch.

They are really starting to scare me with all their inflamatory rhetoric.

:scared:

If their actions lead to violence, will they take responsibility for that?

10. Absolutely. Look at this quote from Gary Bauer:
I know, consider the source, but the right wing listens to him and a hundred like him:

"It is entirely possible that in her death Terri Schiavo will become a symbol for many people about a disturbing trend in American culture," said Gary Bauer, a prominent conservative activist. Predicting a "donnybrook" over the eventual Supreme Court nominee, he said the Schiavo case "will make more acute the feeling at the grass roots that too many of the most important decisions are being made by unelected judges."

From Schiavo Case a Precursor to Battles Ahead, Washington Post

Someone needs to educate Joe Six-Pack of the right wing:

Judges are supposed to be "unelected." If they were elected they would not be independent.
