I think the DOD has blocked me out of their website

1. Yep the site is under attack SERVER ERROR

I've been hitting them with this same question every day since the 2nd anniversary of the war, and I'm going to keep asking it until I get an answer...

Perhaps not the Constitution, but so-called "pre-emptive" strikes are prohibited by the UN Charter, to which the US is signatory. Article 51 thereof permits unilateral military action only in a situation of being under "armed attack", which rules out pre-emption entirely.
