Anybody hear about this new Ohio law?
Edited on Fri Mar-25-05 03:15 AM by FreedomAngel82
I'm listening to Bernie Ward and he's talking about this new law that they have in Ohio. According to this new law the only couple's who can make claims on spousel abuse are married couples. So if a couple is living together and one couple is beating the crap out of the other person they can't use any domestic violence laws because you can't give any special status to unmarried couples. So far it hasn't been contested. A public contender got the rule that if a guy has beat up his girlfriend they can't use domestic laws against him because of the state constiution. WTF?! This guy beats the crap out of the girl and all he gets is mistermener assault?! :wtf:

3. It's actually fall-out from the "gay marriage ban"
In Ohio, a "gay marriage ban" issue was on the ballot for the November 2004 elections (I think either 11 or 12 states had gay marriage issues on their ballots). The issue in Ohio was worded extremely vaguely, so vaguely that all sorts of people and institutions warned not to approve the issue because it could be interpreted far too broadly.

Well, here is an interpretation of it. Here's the wording of it:

"Only a union between one man and one woman may be a marriage valid in or recognized by this state and its political subdivisions. This state and its political subdivisions shall not create or recognize a legal status for relationships of unmarried individuals that intends to approximate the design, qualities, significance or effect of marriage."

5. That is very interesting because----
they used to say if some one beat up some one nest door they, the police, could then do something. It was used that the safety of home and marriage protected the man. Now that used to happen right here in Maine and I knew women that were even told. If you just get out in a public place and he beats you we will do something. Yar told to women. And also that some man could never beat up the man next door as that was really bad. Is it going to be OK now if you know some one he can beat the crap out of you or what? This is crazy.

7. For years I 've had the impression the Ohio was one of the
better states. However, judging from the 2004 election frauds and bills like this one, I was wrong to have respected Ohio. Now it's sounding like a state you'd want to move out of.

I believe that we're the bluest part of Ohio.

10. A few years back, I noticed that Ohio State was one of the
dirtiest football teams in the country. I just blamed the coach and gave it no further thought. In retrospect, maybe something very bad is beginning to happen in Ohio from a cultural standpoint. I don't know what it is but Ohio is looking increasingly "thuggish".

13. Cleveland area is by far the bluest
Democrats regularly win Cuyahoga county by margins of over 100k while barely winning places like Franklin county.

11. Spousal abuse, maybe (?) but domestic violence laws
in Ohio define the relationships under which one can be charged with Domestic Violence way beyond marriage. Someone you have cohabitated with (regardless of sexual relationship- your former roommate can be charged if there is evidence), someone you are related to by blood, someone you have a child with, someone you have dated. In fact, I don't think I recall a specific law regarding "spousal abuse". This sounds wonky to me.

I worked two of the last three years in an Ohio battered women's shelter, incidentally. The laws in OH are not perfect by any means, but they don't make any specific reference to "spousal abuse" IIRC.

12. Thanks to the same sex marriage issue
they do now. That is what happens when you act first, think later.
