If I were Michael Schiavo
I would hire an ambulance and go to the hospice and have her taken out Florida. He is an RN and would be capable of providing any care she needs at this point.
The state does NOT have custody of her(if they did, she would have a feeding tube)and what is he going to be charged with? There wouldn't be anything they could do.
I would then BAN her family from seeing her.
I know that is harsh, but family is banned all the time from seeing patients.
I know this sounds harsh, but these people need some relief from these zealots.

1. There's no need
and further, I don't think he could anyway. She's pretty much under the jurisdiction of the courts now.

It seems that after 15 years, Terri will finally have her wishes fulfilled.

5. Nope
You're wrong. Michael is her guardian. He can take her anywhere he wants to.

7. I don't think so. Medicaid is paying for her care, not Mr. Schiavo.

8. Wrong
The guardian has control over the person. If Michael moves her, medicaid may not pay for future services in a different location.

Medicaid cannot tell any guardian or person where to go or where not to go.

Michael has the power to move her wherever he damn wants, unless you can show me a court order commanding that Terri not be moved by Michael to another location.

10. It was my understanding
that Michael couldn't even have the feeding tube reinserted if he somehow changed his mind tonight - that Terri is essentially under the guardianship of the court at this point.

But whatever the legal status is, I don't think moving her elsewhere would accomplish anything. I think she pass away shortly where she is.

13. I'm not saying it would accomplish anything
I'm just saying that Michael is still the guardian and still has the power to move her to another location if he so desires.

If there is any language in any court order limiting his power as guardian and forbidding him from moving her, then I will stand corrected.

2. I like you idea - would cause a calamity at this point but
it's still a nice way of thinking about who's issue this really is. What a silly thing we are doing here - I wonder how many people were allowed to die with dignity today alone?? Amazing...

3. if I were Michael I'd sue Mr. White Shoes Boone...
he came very close to saying that Michael attempted murder on her. What a Patasshole!

There was mention of Terri low potassium on the CNN wagging tongues tonight, but never was the word bolimia brought up.

4. If he takes her to another state
The parents could start the court battle all over again with new courts.

He's better off keeping her in Floriduh.

6. I don't think he has any rights to take her out of state.
She is on Medicaid and indigent.

9. Show me some legal authority
Show me some legal authority that Medicaid can restrain people from changing locations.

And I'll show you a bogus piece of UNCONSTITUTIONAL authority.

It is called "liberty."

Look it up.

12. He might better leave her there,
it could be very dangerous for him to take her anyplace in a vehicle.

15. I'm not talking about what is wise or prudent or safe
I'm simply saying, THAT AS HER GUARDIAN, Michael can take her anywhere he wants to.

Please.

17. All Medicaid is is a type of insurance
Not a contract binding to you to anything.
He has every right. He is her legal next of kin and you can bet your bippy that if he wasn't, she would have a tube inserted already.
He is an RN. I'm sure he could take care of her anywhere he took her.

11. Good call!!
Florida is full of Seventh Day Adventists...they kept my grandma in the hospital...all she wanted was to go out with a cigarette and a shot of single malt scotch. She was a great card player and a fun grandma. Don't let your loved ones get old in Florida.

14. if shes been in this state for 15 years as someone says, she must be
getting very good attention. Just move her to a another home, she will develope bedsores and eventually die of infection. It would be much more cruel than what is going on now, but hey, no one can say she was starved and the cause of death will just say heart failure. It won't say "heart failure caused by systemic infection related to bed sores"

16. Bedsores aren't an issue now
She is in the process of dying. It won't be much longer.
IF I were Michael, I would just take her somewhere away from all the hullabaloo and let her finish dying in peace without the freak show around her.

18. A court ordered her feeding tube was removed.
Court also ordered what can and can not be done to her, such as she can not be given food orally, or ice chips, etc. How do you think Mr. Schiavo could move her anywhere and not violate the court order?

19. What does moving her have to do with food and ice chips?
Edited on Thu Mar-24-05 02:29 AM by Floogeldy
Show me the court order commanding that her guardian cannot move her to another location and I will admit that I am wrong.

Why, after all of this time, would Michael move her so he can start giving her food and ice chips?
