Oh, sure, you hate "activist judges" when they rule in our favor. Now you're crying because the judges you appointed are actually doing what you say you appointed them to do. Sucks to be you, I guess.

Guess you'll have to keep falling back on that activist Congress of yours,

The Plaid Adder

2. Actually, they're bitching the judges are being activist anyway.
You see, "activist judges" is just code for "we're pissed we pass unconstitutional laws and commit crimes and the judges call us out on it." So even when they use the black and white letter of the law, with pretty much no interpretation necessary, they're still being "activist". Total bullshit.

... appointee. The other two are earlier Bush41 and Clinton appointees. Wilson dissented in the per curiam opinion of Carnes and Hull.

It's also interesting that Wilson is a Notre Dame undergraduate and law school graduate. Is it at all possible that Wilson is Roman Catholic and is permitting his religious beliefs to "inform' his judicial opinion? (A reading of the opinion doesn't give me warm confidence in Wilson's reasoning ability.)

Judge Ed Carnes was appointed to the 11th Circuit Court of Appeals on September 10, 1992 by President George H. W. Bush.
