Scalia to save Schiavo in KKKarl's grand plan
Once the appeal to the Federal Court of Appeals come back against the parents they will appeal to a Supreme Court justice to reinsert the tube pending hearing the full case. That justice will be old Scalia himself who will order the tube reinserted and become a demi god to the RW Christians. Rehnquist will then step down saying a gave it a go but I'm to sick at which point Scalia is enthroned by the religous right as our chief justice of SCOTUS. Absolutely Brilliant and we are all fucked!!

1. no he won't
See the greatest for a previous ruling Scalia issued on this very issue. He's entirely libertarian on right to die issues.

6. You are making the mistake of thinking this is about the law or
anything really. This is about bringing the Judiciary to heel as they have the CIA, FBI and Justice dept. He will rule that so the shrub can declare any judge who doesn't follow his directives will be impeached and removed. They then have complete control over the entire government and if the shrub wishes to declare himself dictator you wont hear a word from the courts. We are done.

7. how much do you want to wager on that?
I believe the Republicans have all kinds of sinister motives. But Scalia will not be able to rule in a manner than conflicts with earlier writings. I'll put money up on it. I read the previous opinion. Have you? I'll look for the link.

2. I'm not so sure.
Didn't Scalia say he supported keeping the tube out? I thought so, but maybe I'm mistaken...

3. Thanks for that nightmare as I get ready to turn in for the night.
Maybe the 11th Circuit is dragging its feet just for that reason? If she dies, it's all moot. But wouldn't this require them to wack Justice Kennedy? Not that they wouldn't do it, just asking.

5. Too bad the appeal to the SCOTUS has to go through Kennedy first
The 11th circuit Court of Appeals is Kennedy's territory, not Scalia's.

11. Correct me if I am wrong, but I believe it is Justice Kennedy
that has jurisdiction over emergency appeals in the 11th Circuit
Court of Appeals.

14. Yes, but the next (and last) stop after the 11th circuit is the SOTUS
Edited on Tue Mar-22-05 10:44 PM by ultraist
The Shiavo attorney said that if it failed in this FL Fed court, it would go to the 11th circuit court, then to the SOTUS.

16. Scalia is convinced he will be the next Chief Justice
I wouldn't want to be Rehnquist attached to a life-support machine while Scalia is standing by my bedside.

15. So, Scalia will be taking orders from the Pope?
What a conflict of interest. That's why we need to be very careful who sits on the SCOTUS. We do, indeed, live under an Ameircan Taliban that is much more powerful and evil than the Taliban of Afghanistan.
