Prediction for Fed Court Round I: Dismissed for Failure to State a Claim
Edited on Tue Mar-22-05 01:35 AM by Sandpiper
That's my prediction for the results of the Schindlers' efforts in U.S. District Court.

Their counsel is arguing that Terri Schiavo has been denied her right to due process...

after 6 courts and 19 judges have heard this case in some shape or form, and without any substantive legal precedent to support his arguments.

>The question still lingers: Regardless of what one thinks of the evidence developed and the procedures followed in the Florida courts, how is a judge empowered, ever, to order or license torture? Let's hope the federal court asks.<

Yes lets use Gonzales as the example here.

So if this judge renders a decision for Michael Schiavo based on law or lack of claim, whatever... neocons label him an activist judge and we roll straight into the nuclear option in confirmation hearings for judges.

All that with the neocons' vegetative flock fired up.

This is depressing.

3. Then the repugs will attack the judge because......
GASP!!!! He was a Clinton appointee. Back to congress, new law, Terri's Law to allow adjudication in a federal court in which a republican appointed judge sharing the moral values and political aspirations of the GOP will be upheld. Very narrow, but certainly not politically motivated. :puke:
