There's NO FUCKING WAY a "Terri Only" bill will be held constitutional
From what I heard the Democrats were told the bill would ONLY apply to Terri Schiavo and not everyone which would cause MONUMENTAL FUCKUPS AND CHAOS across the country.

if that's true there is no chance a "terri only" bill will be upheld

19. Scalia is NOT known for his consistency
He pretends to love states rights, but voted in a coup d'etat to meddle in Florida state electoral law to elevate a chimpanzee to president of the united states.

He is a crazed ideologue and I suspect would find that the forefathers thought Bills of Attainder were just grand, despite the constitution having prohibited them

10. I dont think this supreme court would hold it up.
It is a pretty blatently unconstitutional.

But we can only speculate on just how strong a hold the repubs have on the judges and how much of that hold they would be willing to pull on this issue.

The ruling they made about the 2000 election is what raises concerns... I dunno.

5. One of the Repugs said yesterday during the press conference
that it was NOT a "private law". I can't remember if it was DeLay or one of the others, but it was in response to a question from a reporter about the Constitutional issue.

Of course, who is going to stop them from passing "private laws"? The Supreme Court installed George as president in a "this time only" decision. They can do anything they want to.

7. If it is only for one person
then isn't that a 'bill of attainer' that someone here mentioned as unconstituional? Maybe that is the plan of the dems, go along and know nothing can happen because it is not constitutional and the courts will rule against it. That's what I am hoping anyway. I heard Sen Wyden the other day when they were discussing this and he made that point clearly, that this only pertained to her.

What they want is a judge to order the feedingtube to be reconnected.

After that, any fight either for a reviewing of the case by a judge or for declaring the bill nonconstitutional will last years. They are buying time as much time as they can.

After that, they will try to pass a general bill on this subject that will forbid non intervention.

and to have the parents made legal guardians. Also expect it to take at least another three years in the courts before this is resolved.

It's quite possible that Terri Shiavo could have further deterioration of the brain to the point that autonomic functions cease occurring, she's put on a ventilator, and eventually her heart simply ceases beating. All of this could happen before it gets through the court system if the law is not struck down as unconstitutional immediately.

Plus, there are the problems of the precedent this sets. If at the federal level, any member of the ruiling party determines any civil court case did not come out in the way he/she wanted, the Congress will be capable of intervening at a federal level. Think of it, child custody cases could become federally decided in the Congress. Lawsuits between neighbors where one is a big time Republican donator who caused extreme damage to a neighbor could have the judgement overturned via Congressional decree.

This is usurpation of the judiciary by the legislature and executive branch.

15. There have been private bills for immigration
for decades. Allowing X to get permanent residence who otherwise could not legally. So there is a precedence for this type of law. Doesn't make it any less offensive though.

Jeb Bush tried the same thing and the Fl Supreme Court struck it down saying a law for one person is unconstitutional and ordered Jeb Bush to stay out of it.
