There's an arrest warrant out on Kerik

Holy cow, BushCo just nominated a guy for a cabinet post for whom there was an active arrest warrant! And they wanted the guy to be the head of the agency concerned with national security!

NEWSWEEK has discovered that a New Jersey judge in 1998 had issued an arrest warrant as part of a convoluted series of lawsuits relating to unpaid bills on his condo. The magazine faxed documents, including the arrest warrant, over to the White House around 6:00 p.m. Friday, asking for comment. Neither Kerik nor the White House had any immediate response. At 8:30 p.m., Kerik had submitted his letter to the president.

A law breaker with an arrest warrant is picked by Bush to head up security for the entire country. Your statement implies that just because the guy has only been caught breaking the civil rights of other people he is a stand up guy.

Don't try to minimize it because it's only civil, not criminal.

The person nominated to head up Homeland Security had an arrest warrant hanging over his head. Meaning if he ran a red light and they ran his driver's license, he'd be spending the night in jail.

Remember the line they (you?) used on Clinton all the time:

RULE OF LAW!
RULE OF LAW!

23. A civil arrest warrant?
I think an arrest warrant is always in connection with a crime. Civil matters stay in court and court alone. I don't think there's any such thing as a civil arrest warrant.

27. In IL it is called a rule to show cause
And you can get locked up for it if it gets ignored.

Essentially it is a coercive power by the judge to get you to cooperate in a lawsuit. You get locked up until you post a bond or next time the court is in session.

You get a show cause order in the mail, or maybe delivered by a Sheriff. The article specifically says arrest warrant.

35. Well, it is part of the same procedure
"Rule to show cause" is for you to show up in front of the judge to show cause why you should not be held in contempt of court. If you do not show, then you are in contempt of court and a body attachment order is issued. This is the same as an arrest warrant. Your body is attached by the court. The court could send a deputy out to get you or just have the attachment/warrant pend until you are picked by (usually on a unrelated traffic stop) you come back as having a warrant and you get to spend the night in jail. The warrant is for contempt of court, not anything in the civil action.

But that is IL, not NJ. I have no idea what the law is in NJ.

The difference between a civil matter and criminal matter is that you can't be jailed for civil offenses.

But if there were not criminal laws requiring people to show up for court, people would just ignore all civil court orders and transfer all their assets to their children or parrents.

Bottom line: Kerik is at risk of being charged with a criminal offense.

37. IN America, you can't get locked up for a civil offense. But a civil...
...offense can get converted to a criminal offense if you refuse to cooperate with the court.

That's what contempt of court is. That's what happens when you don't show up for court at all.

Kerik had an arrest warrant out on him because he was ignoring the court in a matter that started off as a civil matter.

This is TOO funny.

38. Yes, there is, only it's called
different things in different states. A major example is if you've been subpoenaed as a witness in a civil trial and you refuse/fail to appear. You can have a warrant sworn out for you and be forced to appear.

I find it... hmm, telling... that Newsweek faxed the document at 6PM Friday and Kerik submitted his letter at 8:30PM Friday.

Quite telling. It was never about employing an illegal immigrant.... it was about this.

So, now we have proof that the * admin isn't vetting its candidates for Cabinet posts at all. This should not sit well with many who voted for *.

But...this sounds like our legal system now. Get caught screwing citizens out of millions through shady deals or book cooking and get a slap on the wrist,$5,000 fine and probation.

Get caught robbing a bank or Credit Union of a couple thousand bucks and do 20 years.

Note to bank robbers,wear a SUIT AND TIE !!

and it seems the bad news continues. So when does the mainstream media start to really debate these issues that are cropping up every single week since November. If all of this was happening in another country we would be declaring that we will pull support, ie, Ukraine. A man that was to be the head of Homeland Sercurity withdraws his intention to fill the post because he is afraid of the fact he may have had an illegal alien working for him. Turns out there was worse in the closet.

What is really scary is that he got this far. Who was checking up on this guy? Is this our "Security"??????? Is it Clintons fault?
