Bumpersticker Vandalism
I went to a meeting of some local democrats. One of attendees had her car keyed at a grocery store parking lot in The (right-wingnut) Woodlands here in Texas. Apparently, her Kerry bumpersticker inspired the following spew written on a note and stuck on her car:

"Why don't you move your ass to Canada, you socialist piece of shit."

Okay. Here's the good part. The 22-year-old woman wrote the note on the back of one of her own credit card receipts.

Sweet.

It may or may not be who that cc slip belongs to so she should check that out thoroughly first.

And then . . . let the insurance company prosecute it. Aren't crimes of religious, political and social persecution called hate crimes? Hmmmmmm. . .

There is no "proof" that the cc slip belonged to the young woman, but the cc slip was in very good shape (not wadded, run over, etc.), so it is very likely that the cc slip belonged to the writer and came right out of her purse.

The car's owner needs to get a sample of writer's handwriting and have it analyzed with the note.

I just can't stop laughing at how stupid that was.

Return to car--note on car and keying.

What do YOU think? If you were on a jury, what would YOU decide?

I love it that wingnuts like this "little lady" cherish freedom of speech as long as you agree with them and love to repress and punish those who express a different opinion. They love our Bill of Rights and respect it so much. NOT!

However, is it CERTAIN that the writer of the note keyed the car? Is it CERTAIN that the credit card receipt belonged to the note writer? Is it CERTAIN that the keying took place in that parking lot? That is what I would want to know if I were on a jury.

I have not keyed a car before, but I have written notes and left them under the wiper blades to people who have irritated me. (usually parking or driving infractions) I have not used personal stationary, but usually whatever is available. Hence a handy receipt blowing through a parking lot. Or hotel stationary. (I confess... I take hotel note pads. I'm a thief)

And to answer your question, I am of the opinion that it appears that the person leaving the note might be the guilty party. The question is whether the receipt belonged to the perp.

20. Reasonable doubt
The receipt had not been run over, crumpled, or stained. What do you think a forensics expert would think? Certainty is not the standard of proof. What would make you have "reasonable doubt" that the receipt belonged to the perp? And before you answer this last question, may I refer you to post #2.

... but you would have to either get a confession from this woman, or take it to criminal court, if law enforcement thought there was enough evidence. There you would have to convince a jury (all of them) that his woman indeed keyed the car. You could reasonably convince them that the note is hers, and is in her handwriting. Proving that she keyed the car is another issue.

I don't want to seem arguementative. I have just seen the justice system work in this country once too often.

Now, in civil court, all you need is a majority to believe you. (a perponderence of evidence)

Good luck with the Repug creep. :)

start that thread and discuss your issues regarding the benefit of school vouchers. I would very much like to hear plan of how vouchers will help students afford $12,500 a year for tuition when the average state spends less than half of that per student per year. Should the state fund the difference, and if so where will the money come from? This should provide an initial talking point for your thread.

Nothing in this life is CERTAIN. That's why even in death penalty cases, the standard of proof is not "beyond any shadow of a doubt."

And the standard of proof in a civil case is preponderance of the evidence. Just 51-49%.

If I'm on that jury, the preponderance of the evidence is that the person who wrote the note keyed the car.

I'm not home now (dorming), but I found out that someone stole all my bumper stickers. Didn't hurt the truck, just peeled off all the stickers.

However, I did take guilty pleasure on vacation this summer when I saw a bunch of Bush bumperstickers posted in accessible places other than cars that had LIAR scrawled across them with Magic Marker. Many different towns along the East Coast.

I've been printing bright yellow "Worst President Ever" bumperstickers -- with a big red "W".

I print them on magnetic stock -- I don't want to actually glue anything to my Jeep.

So far, three of them have been ripped off. And that's a GOOD THING.

If they hated them -- GOOD!

If they liked them -- GOOD!

In the text of her letter to the editor of our local newspaper, the victim says that "I intend to hold you legally and financially responsible for scratching my car." I see no other sure way than to have a tape from the security camera.
