If the DOJ has the goods on Padilla, why don't they charge him?

If the DOJ has the goods on Padilla, why don't they charge him?
I think it's because they don't have the goods, and I think they're nakedly trying to influence the SC decision by releasing their alleged "new information" now.

Untrustworthy scum.

2. DOJ can not used confession obtained by torture
At the very minimum, Padilla's Miranda rights have been violated by denying him access to a lawyer during questioning. Any confession obtained during such questioning would not be admissible.
