Ages of the current SCOTUS Justices/why Bush has to be defeated
William Rehnquist - will turn 80 in October

John Paul Stevens - 84

Sandra Day O'Connor - 74 and breast cancer survivor

Antonin Scalia - 68

Anthony Kennedy - 67

David Souter - 64

Clarence Thomas - 55

Ruth Bader Ginsburg - 71, and has had recurring bouts of colon cancer

Stephen Breyer - 65


As many as four justices might not see the end of the next presidential term. Four more years of Bush could mean 3 or 4 Scalia clones on the high court and Antonin Scalia becoming Chief Justice.

1. Yeah - I was thinking about this the other day
When Stevens was talking about the death penalty and the article mentioned his age. It's a really scary prospect. I just pray they all make it through January 20th. If Bush is reselected, we are truly screwed.

3. This is a good motivator
But I remember the last election when pretty much the same argument was used. This time, fortunately (well, unfortunatley, I guess) we have many more examples of Bush administration incompetance.

7. I think the only thing holding back Rehnquist and O'Connor
Is the decision in Bush v. Gore. Their retirement on the heels of that decision would have irreparably damaged their legacies and permanently branded them as political partisans in the eyes of legal scholars.

If Bush gets four more, then they have nothing to worry about.

As for Stevens, we all know that the guy can't live forever.

And with Ginsburg, another flare up of colon cancer might make her unable to fulfill her duties as a Justice.

4. This is the single biggest reason why Kerry must win
It will not only affect the next 4 years. A Supreme Court justice can have an impact for 40 years.

8. Remember -- ALL federal judges serve life terms and Daschle
has just agreed to approve at least as many as 25 of *'s judicial nominees.

It was supposedly a "compromise," an agreement not to fillibuster any of *'s nominees in exchange for * not making any recess appointments.

Well, DUH, Tommy-D, are you fucking aware that those recess appointments, as bad as they may be, are TEMPORARY, but the ones you agreed to approve will be PERMANENT?

Oh, goddess, save me from compromising wimps!

...during Bush's term.

Do you think the older conservatives on the SCOTUS are paleocons rather than neocons? Maybe they're hanging on for dear life just like Stevens- the prospect of an ultra-RW Justice taking their place may be too much to bear for someone like O'Connor.
