since the US government is saying it is penalizing these soldiers, the International Criminal Court loses jurisdiction...not that the US government would allow it to try soldiers anyway.

6. I am confused about this
My guess is that Saddam did not sign up for this deal either, but I believe he is in jail anyway, so there must be some exception for superpowers and superheros such as our great leader.

But what the US opted out of was criminal prosecution. I am not sure if you can sue another country, its leaders, etc, for a violation of human rights.
