Justice Scalia says judicial proceedings are "too partisan"
He says that the way we pick judges is just too darned partisan and acrimonious. Plus, Scalia says he's dismayed at the idea of tampering with the Constitution. I guess he's AGAINST the Federal Marriage Amendment, then.

10. Some of the things he says
are pretty hard to believe. Isn't he the one that said guilt or innocence should not necessarily be a factor in determining whether or not to administer the death penalty? Or was that Rehnquist?

13. Scalia has forfeited right to by CJ
Before Bush v. Gore, Scalia would have been considered for the chief justice slot when Rehnquist retires. After Bush v. Gore and now after refusing to recuse himself in the Cheney energy task force case, Scalia's only chance to be chief justice is if the GOP has 60 senators and Bush wins in November.

14. Does he have the faintest idea of the irony of his statements.
His point seems to be that there are still moderates on the bench and so long as they are there, or in congress, the judiciary is too political. Conservatives aren't political.

Stunning from a supposedly brilliant man.
